SPECIAL CONDITIONS FOR CASE BLD02-00052
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on February 12, 2002 for the potential presence of Environmentally
Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
SUSC Aquifer, Blue Heron, Osprey, Eagle, Suburban Shoreline.
2.) Aquifer Recharge Areas in Jefferson County are characterized by formations that allow percolation of the surface water into the soils and the underlying
zone of saturation. Aquifers are geologic formations that contain sufficient saturated
permeable material to yield significant quantities of water to wells and springs. Aquifers
serve as the source of drinking water within most of the rural portions of Jefferson County.
3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions
that promote rapid infiltration of recharge waters to groundwater aquifers.
4.) Stormwater runoff tightline piping can be subject to weakening through ultraviolet radiation
exposure and mechanical damage due to trees, rocks and debris. A more durable
material for the tightline will provide greater defense against the elements.
5.) Evidence suggests that the bluff area related to the parcel in question is subject to erosion
and mass wasting. Vigilant maintenance of the stormwater runoff tightline to the beach is
important to avoid a negative contribution to bluff instability.
6.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water
quality degradation. The submitted proposal does not require additional aquifer
protection measures. However, during construction the project shall follow the Best
Management Practices (BMPs) and facility design standards as identified and defined in
the Stormwater Management Manual for the Puget Sound Basin.
7.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
8.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
9.) Maximum lot coverage is not to exceed 25%.
10.) Minimum setback from Ludlow Bay road is 20 feet. Minimum side setbacks are 5 feet.
Minimum shoreline setback from the top of the bank is thirty (30) feet.
11.) The building height is not to exceed 35 feet.
12.) Residential developers and individual builders shall be required to preserve shoreline
vegetation and reduce the associated risk of erosion during construction and any future
activity which may impact the stability of the shoreline.
13.) The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive
Land Use Map effective August 28, 1998.
14.) The parcel was created through the Ludlow Beach Tracts No 2 Subdivision on November
4, 1948.
15.) Ludlow Bay Road (C508209) is a local access road. The road approach is existing.
16.) The applicant/owner and all future owners are responsible for maintaining and protecting
the stormwater runoff tightline to the beach against damage due to normal wear, weather
exposure, and/or trees, rocks and debris. If and when damage occurs to the tightline that
renders it ineffective, the responsible party must execute the necessary repairs as soon
as possible and no longer than 30 days.
17.) The stormwater runoff tightline piping must be composed of durable material that is
resistant to weakening and damage due to time, weather exposure (including ultraviolet
radiation), and impacts from trees, rocks and debris. The corrugated plastic material used
for tightline construction in the past is no longer acceptable. More durable plastic or
ultraviolet radiation-resistant flexible rubber material shall be required.
18.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat
management plan.
19.) A septic permit(SEP96-00117) was finaled on 12/17/96 fora three bedroom system. A
building permit(BLD96-00270)was finaled on 2/21/97 for a single family residence.
Critical area review for the single family residence was conducted under CAR96-00059. A
shoreline exemption (XMP96-00076)was issued 12/20/96 for a bulkhead with the
bulkhead's critical area review conducted under CAR96-00152. A Substantial
Development Permit(SDP97-00001) was issued 9/2/97 to construct wooden stairs and
landings to allow beach access. The building permit(BLD97-00669) for the beach stairs
was finaled on 1/12/98. A building permit(BLD99-00531) for a carport and storage
addition was finaled 1/13/00 with critical area review conducted under CAR99-00330. A
septic permit (SEP02-00030)was approved March 5, 2002 to serve the satellite bedroom.
20.) The parcel is located >800 feet but within 1/2 mile from an eagle nest and within 250
horizontal feet of the shoreline or top of high bank bordering a shoreline. An Eagle Plan
was approved by Shelly Ament of Washington Department of Fish & Wildlife March 4,
2002.
21.) Shelly Ament of Washington Department of Fish & Wildlife commented on the aplication
on February 20, 2002 and stated a conflict did exist for Eagle Habitat. An Eagle Plan
must be submitted.
22.) This approval is for a Satellite Bedroom only. Any future permits on this site are subject to
review for consistency with applicable codes and ordinances and does not preclude
review and conditions which may be placed on future permits.
23.) The revised site plan as submitted with the building application on February 13, 2002 has
been reviewed for consistency under the UDC, and has been approved County Department of Community Development. Any modifications, changes, and/or
additions to the stamped, approved site plan dated March 5, 2002 shall be resubmitted for
review and approval by Jefferson County Department of Community Development.
24.) As per the approved Eagle Plan dated March 4, 2002, the applicant shall retain all known
perch trees and conifers >/=24 inches diameter at breast hight(d.b.h.). The applicant
shall also retain >/=50% of pre-clearing or pre-construction conifer stand with diameter
distributions representative of the original stand (>6 feet tall). Windowing and low limbing
of trees is acceptable provided no more than 30% of the live crown is removed.
25.) The stormwater runoff tightline shall be designed and placed in order to minimize visual
impacts to users of the beach and nearby waters.
