SPECIAL CONDITIONS FOR CASE BLD02-00057 S
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on February 12, 2002 for the potential presence of Critical Areas(CAs)
under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following CAs were confirmed to be present on the subject property: Level
1 (slight) landslide hazard on western 1/3 of the property;and Osprey Nest.
2.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type,
geologic material, and groundwater that may combine to create problems with slope
stability, erosion, and water quality during and after construction or during natural events
such as earthquakes or severe rainstorms.
3.) A geotechnical report was not required or submitted for the single family residence with
attached garage.
4.) Based on earlier review by the Washington State Department of Fish and Wildlife related
to osprey nest in the vicinity, the subject property is located within 1/4 mile from the
nearest osprey nest. No observations of nesting osprey were documented. Because the
proposed activity is greater than 660-feet from any documented osprey nest, it is unlikely
that the activity will impact the osprey located in the vicinity of the subject property. WDFW
recommended that the applicant consider the following information -"the removal of
snags or live trees suitable for nesting may impact future nesting of osprey by eliminating
potential nesting structures and should be avoided. Construction during the nesting period
(April 1st through October 1st) should be avoided if a nesting pair is identifed within 660
feet of the proposed construction."
5.) The applicant is proposing to create or add 3,41 square feet of impervious surface and
4060 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson
County Unified Development Code requires that your proposal submit a Small Parcel
Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and
Sediment Control Plan.
6.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by
the Department of Community Development. Once the subject permit has been issued
the applicant shall fully implement the provisions of the submitted plan and contact the
Jefferson County Department of Community Development to arrange a schedule to
inspect the property for plan compliance. A Certificate of Occupancy will not be issued
until the Department verifies plan compliance. No clearing for roadways or utilities shall
occur on the project site until clearing necessary for the installation of temporary
sedimentation and erosion control measures have been completed.
7.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
8.) The parcel is a legal conforming lot that is designated Single Family-4 dwelling units per
acre (MPR-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Map
effective 8/28/98.
9.) This approval is for a single family residence with attached garage only. Any future
permits on this site are subject to review for consistency with applicable codes and
ordinances and does not preclude review and conditions which may be placed on future
permits.
10.) The revised site plan dated March 14, 2002 as submitted in conjunction with the building
permit application on February 5, 2002 has been reviewed for consistency under the Port
Ludlow Code and Development Agreement. It has been approved by Jefferson County
Department of Community Development. Any modifications, changes, and/or additions to
the approved revised site plan dated March 14, 2002 shall be resubmitted for review and
approval by Jefferson County Department of Community Development.
11.) Maximum Impervious Surface shall not exceed 45 percent.
12.) Minimum setback from the Highland Drive right-of-way line shall be 20 feet. Minimum side
yard setbacks shall be 5 feet. Minimum rear yard setback shall be 20 feet, based on
requirements of the approved South Bay No. 1 subdivision plat.
13.) The building height shall not exceed 35 feet.
14.) Based on Section 3.107 of the Port Ludlow Code, accessory dwelling units shall not be
allowed in the MPR-SF zone.
