The application was reviewed by the Jefferson County Department of Community Development staff on March 13, 2002 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance(JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Osprey Habitat and Steep Slopes in Ravine. 2.) The Washington State Department of Fish and Wildlife Area Habitat Biologist visited the property on March 14, 2002. Their comments were "The existing level of development, the topography, and the distance from the nest indicate that this proposal will not have a significant impact on the osprey. However, retention of the two mature Western red cedar trees should be encouraged to provide a visual screen as well as future perching and/or nesting habitat." 3.) This parcel (990400123) has been tagged indicating that a field check for a ravine and storm drainage are needed prior to issuance of any permits. Staff visited the property on March 27, 2002 and noted that a majority of the property had been cleared. Staff also noted the presence of a small, shallow swale running in a east-west direction on lot 23 of the two contigious lots. There was no evidence that water had ran into or in the shallow swale. The property including the swale gently slopes to the east and away from the adjoining street(Helm Lane). It was not evident how runoff water from impervious areas would be handled because the Small Parcel Erosion and Sediment Control Plan state that runoff from impervious surfaces will be dispersed to a"existing drainage ditch located on lot#23. We will tightline downspouts to drainage ditch." Per Revision dated 3/29/02, stormwater runoff will be tightlined to a 12-yard drywell constructed on site. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 5.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The parcel is a legal non-conforming lot that is designated as Single Family-4 Dwelling Units Per Acre (MPR-SF 4-1) under the Jefferson Comprehensive Plan Land Use Map effective August 28, 1998. 7.) The site plan dated February 20, 2002 as submitted in conjunction with the building permit application has been reviewed for consistency under the UDC. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the approved site plan date stamped March 29, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 8.) The applicant has filed a Declaration of Restrictive Covenant with the Jefferson County Auditor's Office under AFN 453789 for the purpose of treating lots 23 and 24 of the Port Ludlow No. 1, Area 1Subdivision as one building tract. Therefore, by covenant, lots 23 and 24 constitute a single building site that runs with the land. 9.) Maximum Impervious Surface Area shall not exceed 45 percent. 10.) Maximum setback from Helm Lane right-of-way line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 11.) The building height shall not exceed 35 feet. 12.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, accessory dwelling units shall not be allowed in the MPR-SF zone. 13.) The applicant is proposing to create or add 3443 square feet of impervious surface and 3443 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and Sediment Control Plan AND Revised Page 5, Question 3, to read "we will tightline downspouts to 12 yard drywell."The revision was made 3/29/02. • 14.) A REVISED Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 15.)
