SPECIAL CONDITIONS FOR CASE BLD02-00090 •
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on March 13, 2002 for the potential presence of Critical Areas (CAs)
under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following CAs were confirmed to be present on the subject property:
Osprey Nest and Type 5 Stream mapped adjacent to subject property .
2.) The Washington State Department of Fish and Wildlife Area Habitat Biologist reviewed
the application for potential impacts to a mapped Osprey Nest in the vicinity of the
proposed activity. Their March 21, 2002 review letter indicated "The existing level of
development, the topography, and the distance from the nest indicate that this proposal
will not have a significant impact on the Osprey. However, retention of the mature conifer
trees should be encouraged to provide a visual screen as well as future perching and/or
nesting habitat."
3.) The Jefferson County Department of Public Works issued the applicant a road approach
permit[RAP01-00091] on July 10, 2001, subject to conditions.
4.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
5.) The parcel is a legal conforming lot that is designated as Single Family -4 Dwelling Units
Per Acre - [MPR-SF 4:1] under the Jefferson County Comprehensive Plan Land Use Map
effective August 28, 1998.
6.) This approval is for a single family residence with attached garage only. Any future
permits on this site are subject to review for consistency with applicable codes and
ordinances and does not preclude review and conditions which may be placed on future
permits.
7.) The revised site plan submitted March 18, 2002 in conjunction with the building permit
application submitted on February 21, 2002 has been reviewed for consistency under the
Port Ludlow Master Planned Resort Code. It has been approved by Jefferson County
Department of Community Development. Any modifications, changes, and/or additions to
the approved revised site plan date stamped March 18, 2002 shall be resubmitted for
review and approval by Jefferson County Department of Community Development.
8.) The applicant is proposing to create or add 3,948 square feet of impervious surface and
3,948 square feet of land disturbing activities. Section 4 of the Jefferson County Strorm
Water Management Ordinance requires that your proposal submit a Small Parcel Erosion
and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and
Sediment Control Plan on March 18, 2002.
9.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by
the Department of Community Development. Once the subject permit has been issued
the applicant shall fully implement the provisions of the submitted plan and contact the
Jefferson County Department of Community Development to arrange a schedule to
inspect the property for plan compliance. A Certificate of Occupancy will not be issued
until the Department verifies plan compliance. No clearing for roadways or utilities shall
occur on the project site until clearing necessary for the installation of temporary
sedimentation and erosion control measures have been completed.
10.) Based on Section 3.105 [bulk and dimensional requirements] of the Port Ludlow Master
Planned Resort Code, maximum impervious area shall not exceed 45 percent of lot 89.
11.) Based on Section 3.105 [Bulk and Dimensional Requirements], minimum setback from
Machias Loop Right-of-Way line shall be 20 feet. Minimum side and rear yard setbacks
shall be five (5) feet.
12.) Based on Section 3.104 [Height Restrictions], the building height shall not exceed 35 feet.
13.) Based on Section 3.107 [Accessory Dwelling Units], accessory dwelling units shall not be
allowed in the MPR-SF zone.
