Budget negotiations continue to move forward, but at a glacial pace. Hours before leadership met on negotiations, Govenor Ferguson chimed in <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=3dfaca55ba&e=7ccb4f03e2> on the Democrats' $12 billion revenue proposal to solve the budget deficit. Offering no solution, the Governor said, "Raising $12 billion in taxes is unsustainable, too risky, and fails to prepare Washington state for the crisis that looms ahead adequately". This is a good civic reminder that the Govenor has veto authority, which could deny any legislatively approved plan sent to him, and the Democrats are just shy of a few votes in each chamber to overturn such a veto. Negotiations on the transportation budget continue, with the hope that over this weekend, the leadership of both Transportation Committees will agree. The Transportation budget continues to be woven within the operating budget, putting its fate in the hands of what happens with the larger of the three budgets the legislature must pass (Operating, Transportation, and Capital). Finally, two weeks ago, I mentioned that the House chambers' budget underfunded the Regional Mobility Grant by about half. I am happy to say I stand corrected. The way the proviso was written didn't provide much clarity. However, after a bit of explaining, it's important to note that I stand corrected. The Regional Mobility Grant is fully funded in the final House version. This makes both chambers' proposals nearly sustain all transit grants. By this time next week, we should have clarity as the legislative session constitutionally ends on the 27th of April, and the legislature must pass their budgets. Ahead of the FY 2026 budget request, a preliminary outline – often referred to as a “skinny budget” – is anticipated to be released by late April. The Maine Senator shared <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=3564e1fc36&e=7ccb4f03e2> that “The administration is talking about giving us some toplines this month, but not a full budget until mid-May. That is extremely late, so we have decided that we will just proceed with our hearings and briefings, and have put out an aggressive schedule.” Once the budget request becomes available, our team will provide a detailed overview of key provisions of particular relevance to local governments for your awareness. Energy, Environment, and Resilience Federal Courts * On Tuesday, Judge Mary McElroy from the U.S. District Court for the District of Rhode Island issued a nationwide preliminary injunction <https://watransit.us12.list-manage.com/track/click?u=6c70c3a 1d76c22fe2ef2a8361&id=c186151c00&e=7ccb4f03e2> preventing the Administration from freezing federal funding for climate and infrastructure projects awarded under the Inflation Reduction Act (PL 117-169) and Infrastructure Investment and Jobs Act (PL 117-58). The injunction, which will remain until the judge rules on the merits of the lawsuit, orders the U.S. Environmental Protection Agency (EPA), U.S. Department of the Interior (DOI), U.S. Department of Energy (DOE), and other agencies to resume disbursing funding immediately. In the order, Judge McElroy wrote, “Agencies do not have unlimited authority to further a President’s agenda, nor do they have unfettered power to hamstring in perpetuity two statutes passed by Congress during the previous administration.” * Separately, Judge Tanya Chutkan from the U.S. District Court for the District of Columbia issued a preliminary injunction <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a 8361&id=87b589ddec&e=7ccb4f03e2> preventing EPA from terminating nearly $14 billion in funding designated for the Greenhouse Gas Reduction Fund (GHGRF). Judge Chutkan determined that the agency’s claims foffraud and mismanagement were "vague and unsubstantiated" and ordered Citibank, the entity tasked with disbursing the funds, to release the funds to the nonprofit recipients. Trade White House * Last Friday, the Trump Administration announced <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=53d2c1f841&e=7ccb4f03e2> that a variety of electronics would be excluded from its 125 percent reciprocal tariffs on China that took effect last week, including computers, smartphones, and certain components. The Administration clarified that the products were still included under 20 percent tariffs on China enacted earlier this year. They may also face additional tariffs as part of a potential forthcoming package on imports of semiconductors and semiconductor manufacturing equipment, where the Administration launched a preliminary investigation <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c2 2fe2ef2a8361&id=c5317c5b90&e=7ccb4f03e2> this week. The White House also took steps this week to investigate imports of pharmaceuticals <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1 d76c22fe2ef2a8361&id=543ab05d5d&e=7ccb4f03e2> and pharmaceutical ingredients as well as critical minerals <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=0ee1af4b5 d&e=7ccb4f03e2> and derivative products for future tariffs. * Federal Reserve Chairman Jerome Powell warned <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=b947996ebf&e=7ccb4f03e2> on Wednesday that the Administration’s tariff regime could result in “higher inflation and slower growth,” which led to declines in the stock market. He indicated that the Fed would “wait for great clarity” before making any decisions about lowering interest rates. President Donald Trump responded <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=1698ce2c97&e=7ccb4f03e2> to the Chairman’s remarks with frustration, offering that “Powell’s termination cannot come fast enough.” Meanwhile, the State of California filed <https://watransit.us12.list-manage.com/track/clic k?u=6c70c3a1d76c22fe2ef2a8361&id=8fa9025a49&e=7ccb4f03e2> a lawsuit <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=139ec9d041&e=7ccb4f03e2> challenging the Administration’s use of the International Economic Emergency Powers Act (IEEPA) to implement tariffs, arguing that it is “unlawful and unprecedented.” Permitting White House * President Donald Trump this week signed <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=0651a85ebd&e=7ccb4f03e2> a Presidential Memorandum <https://watransit.us1 2.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=3622028908&e=7ccb4f03e2> intended to enhance technology used to conduct environmental reviews and evaluate permits for infrastructure projects.
