SPECIAL CONDITIONS FOR CASE BLD02-00106
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on March 21, 2002 for the potential presence of Critical Areas (CAs)
under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following CAs were confirmed to be present on the subject property: Slight
Landslide Hazard Area and Great Blue Heron Colony.
2.) A geotechnical report was not required for the single family residence with attached
garage. A Geotechnical Report dated January 15, 1997 was prepared for the subdivision
plat. The approved report is on file with the Jefferson County Department of Community
Development. The report contains information and recommendations relating to site work,
construction activity and related matters associated with soils and slope stability. Per plat
conditions, all construction and clearing activities on any lot within Timberton Village
Phase III shall either 1) comply with the recommendations in the report; or 2) comply with
the recommendations of an alternative geotechnical/engineering report approved by the
Jefferson County Department of Public Works and the Department of Community
Development. The applicant provided a letter from GeoResources as documentation that
the recommendations of the January 1997 Geotechnical Report have or will be complied
with.
3.) During SEPA environmental review for the Plat of Timberton Village, Washington State
Department of Fish and Wildlife Area Habitat Biologist Tim Rymer conducted a field
evaluation to determine the presence of fish and wildlife habitat on the subject property.
Mr. Rymer and other Department of Fish and Wildlife personnel concluded that the
suspected Great Blue Heron rockery was not located as mapped in the Jefferson County
Critical Areas Ordinance, but, that it was in fact located in the NE Quarter of the NW
Quarter of Section 20, Township 28 North, Range 1 East, which is approximately 1/2 mile
south of the project site.
4.) The applicant is proposing to create or add 3372 square feet of impervious surface and
3272 square feet of land disturbing activities. Section 4.1 of the Jefferson County
Stormwater Management Ordinance and Final Plat conditions requires that your proposal
submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a
Small Parcel Erosion and Sediment Control Plan.
5.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by
the Department of Community Development. Once the subject permit has been issued
the applicant shall fully implement the provisions of the submitted plan and contact the
Jefferson County Department of Community Development to arrange a schedule to
inspect the property for plan compliance. A Certificate of Occupancy will not be issued
until the Department verifies plan compliance. No clearing for roadways or utilities shall
occur on the project site until clearing necessary for the installation of temporary
sedimentation and erosion control measures have been completed.
6.) For disturbance of vegetation in any area with a combination of slopes greater than 15
percent with impermeable or slowly impermeable soils, ground water seepage, or
potentially unstable soils, the following conditions shall apply, whenever feasible: Existing
vegetation in these areas shall remain in undisturbed condition. If the area is unvegetated
due to a previous disturbance, immediate efforts shall be required to provide a persistent
native vegetative cover to prevent erosion or hazard in order to minimize impacts to
environmentally sensitive areas and on-site vegetation, authorized clearing shall be
designed to minimize impacts to soil and understory by providing for sequencing and
staging where appropriate.
7.) In the event archaeological s are discovered during construction, burs and lot
owners shall oberve the following protocol: Stop Work,do not further distrub the area or
remove any materials therefrom. Notify immediately the Jefferson County Director of
Community Development, 360-379-4450. The Director of Community Development will
immediately notify the Washington State Office of Archaeology and Historic Preservation
("OAHP")at 360-407-0752. Protect the area from vandals and collectors. Obtain the
services of a qualified Archaeologist to evaluate the site and make recommendations for
further work in the area. If further excavation or disturbance of the site is necessary,
obtain the appropriate permit from OAHP. Proceed only in compliance with the terms and
conditions of said permit.
8.) Construction within this plat may be subject to truck route and work hour restrictions
designated nad enforced by Jefferson County Department of Public Works. All
construction activity shall be conducted between the hours of 7:00 am and 6:00 pm.
9.) The plat of Timberton Village Phase III is part of a 130-acre single family residential
subdivision on approximately 94.5 acres. Preliminary approval of the 130 residential lots
was granted January 20, 1998. Final Plat approval for the plat of Timberton Village Phase
III (consisting of 19-lots) was recorded August 29, 2001.
10.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
11.) This approval is for a single family residence with attached garage only. Any future
permits on this site are subject to review for consistency with applicable codes and
ordinances and does not preclude review and conditions which may be placed on future
permits.
12.) The site plan as submitted with the building permit application on March 1, 2002 has been
reviewed for consistency under the Port Ludlow Master Planned Resort Code. It has been
approved by Jefferson County Department of Community Development. Any
modifications, changes, and/or additions to the approved site plan date stamped April 1,
2002 shall be resubmitted for review and approval by Jefferson County Department of
Community Development.
13.) Maximum Impervious Surface Area shall not exceed 45 percent.
14.) The parcel is a legal conforming lot that is designated as Single-Family (MPR-SF 4:1)
under the Jefferson County Comprehensive Plan Land Use Map effective August 28,
1998.
15.) Minimum setback from Timber Heights Drive right-of-way line shall be 20 feet. Minimum
side yard setbacks shall be 5 feet. Minimum rear yard setback shall be 5 feet.
16.) The building height shall not exceed 35 feet.
17.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, Accessory
Dwelling Units shall not be allowed in the MPR-SF zone.
