The application was reviewed by the Jefferson County Department of Community Development staff on April 3, 2002 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline Wetland Area; Shoreline Flooding; Bald Eagle Nesting Territory; Type 1 Marine Waters; and Conservancy Shoreline Designation. 2.) The Washington Department of Fish and Wildlife entered into a Bald Eagle Management Plan with the applicants (William and Elizabeth Richardson) on May 21, 2002. The plan establishes one (1) condition. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 4.) The parcel is a legal non-conforming lot that is designated Rural Residential (RR 1:5) under the Jefferson County Comprehensive Plan Land Use Map, effective August 28, 1998. 5.) This approval is for a Mobile Home Installation only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The site plan as submitted with the building permit application on March 15, 2002 has been reviewed for consistency under the UDC. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the approved site plan date stamped July 15, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) The applicant entered into a Bald Eagle Management Plan with Washington Department of Fish and Wildlife on May 21, 2002. Compliance with the following conditions will be determined by WDFW Wildlife Biologist Shelly Ament. The conditions are: Any lot located more than 800 feet but within 1/2 mile from a nest and within 250 horizontal feet of the shoreline or top of a high bank bordering a shoreline: Retain all known perch trees and conifers> 24 incles diameter at breast height(d.b.h.). Also retain > 50 percent of pre-clearing or pre-construction conifer stand with diameter distributions representative of the original stand (>6 feet tall). Windowing and low limbing of trees is acceptable provided no more than 30 percent of the live crown is removed. 8.) The applicant is proposing to create or add 1675 square feet of impervious surface and 2000 square feet of land disturbing activities. Section 3.6.5(c)(3) of the Jefferson County Unified Development Code requires that your proposal infiltrate storm water runoff on-site, to the maximum extent practicable. The applicant's engineer prepared and submitted a Stormwater Site Plan/Erosion and Sediment Control Plan dated May 30, 2002. The Plan includes an analysis and design of proposed runoff control facilities. Runoff from the driveway and parking area will be conveyed to the catch basin by the inverted crown of thedriveway and into the catch basin filter for treatment. Roof runoff will be directed by PVC tightlines into the catch basin below the filter. Treatment of the 6-month stormwater runoff will be accomplished by a Model SIFT 1824 catch basin insert filter manufactured by REM, Inc. This filter insert is capable of removing 99.4 percent of oil and other petroleum based products at flowrates up to 30 GPM (0.067 CFS). Sediments and floatable debris will be captured by the filter and the catch basin sump. Given the small lot size, steep marine bluff, soil type, limited area for a reserve infiltration trench and the potential close proximity to relatively impervious surface layers, infiltration of the stormwater runoff was determined to be not advisable. Collection of the stormwater in a subsurface vault for pumping uphill to the existing conveyance system was considered. Since the cost for an active system capable of capturing the 100-year storm (approximately $4000-$5000)would result in the release of stormwater to the receiving waters only 300 plus/minus feet from the design location, upland off-site disposal was determined to be not advisable. 9.) Maximum Impervious Surface Area shall not exceed 25 percent. 10.) Minimum setback from North Bay Way right-of-way line shall be 20 feet. Minimum side yard setbacks shall be 5 feet. Minimum setback from the top of the shoreline bluff shall be 32 feet. I 11.) The building height shall not exceed 35 feet. 12.) A geotechnical report was not required or submitted for the Manufactured Home Installation permit. 13.) A septic system and drainfield was installed on the parcel under permit SEP78-00112. The permit was issued June 7, 1978 and finaled September 17, 1999. 14.) A Storm Water Site Plan & Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 15.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. 16.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval.
