The application was reviewed by the Jefferson County Department of Community Development staff on April 4, 2002 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Slight (level 1) Landslide Hazard Area and Great Blue Heron Colony. 2.) A geotechnical report was not required for the single family residence with attached garage. A Geotechnical Report dated January 15, 1997 was prepared for the Timberton Village Phase III plat. By letter dated April 25, 2001, the applicant's geotechnical engineer verified that the recommendations of the January 1997 Geotechnical Report have been satisfactorily completed. 3.) During SEPA environmental review for the plat of Timberton Village, Washington State Department of Fish and Wildlife Area Habitat Biologist Tim Rymer conducted a field evaluation to determine the presence of a fish and wildlife habitat area on the subject property. Mr. Rymer and other Department of Fish and Wildlife personnel concluded that the suspected Great Blue Heron rookery was not located as mapped in the Jefferson County Critical Areas Ordinance, but, that it was in fact located in the NE Quarter of the Northwest Quarter of Section 20, Township 28 North, Range 1 East, which is approximately 1/2 mile south of the project site. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 5.) The parcel is a legal conforming lot that is designated Single Family -4 Dwelling Units Per Acre(MPR-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Map, effective August 28, 1998. 6.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 7.) The site plan as submitted with the building permit application on March 25, 2002 has been reviewed for consistency under the Port Ludlow Master Planned Resort Code. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the approved site plan date stamped April 4, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 8.) For disturbance of vegetation in any area with a combination of slopes greater than 15 percent with impermeable or slowly impermeable soils, ground water seepage, or potentially unstable slopes, the following conditions shall apply: Whenever feasible, existing vegetation in these areas shall remain in an undisturbed condition. If the area is unvegetated due to a previous disturbance, immediate efforts shall be required to provide a persistent native vegetative cover to prevent erosion or hazard. In order to minimize impacts to environmentally sensitive areas and on-site vegetation, authorized clearing shall be designed to minimize impacts to soil and understory vegetation by providing for sequencing and staging where appropriate. 9.) In the event archaeological items are discovered during construction, builders and lot owners shall observe the following protocol: Stop Work, Do Not Further Disturb the Area or Remove Any Materials Therefrom. Notify Immediately the Jefferson County Director of Community Development, 360-379-4450. The Director of Community Development will Immediately Notify the Washington State Office of Archaeology and Historic Preservation (OAHP) at 360-407-0752. Protect the area from vandals and collectors, obtain services of a qualified archaeologist to evaluate the site and make recommendations for further work in the area. If further excavation or disturbance of the site is necessary, obtain the appropriate permit from OAHP, proceed only in compliance with the terms and conditions of said permit. 10.) Construction within this plat may be subject to truck route and work hour restrictions designated and enforced by Jefferson County Department of Public Works. All construction activity shall be conducted between the hours of 7:00 am and 6:00 pm. • 411 11.) The applicant is proposing to create or add 3356 square feet of impervious surface and 3116 square feet of land disturbing activities. Section 4.1 of the Jefferson County Stormwater Management Ordinance and plat conditions of the Timberton Village Phase Ill subdivision requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and Sediment Control Plan with the application. 12.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 13.) Maximum Impervious Surface Area shall not exceed 45 percent. 14.) Minimum setback from Timber Heights Drive right-of-way shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 15.) The building height shall not exceed 35 feet. 16.)
