SPECIAL CONDITIONS FOR CASE BLD02-00335 410
1.) The application was reviewed by the Jefferson County Department of Community
Development for the presence of Environmentally Sensitive Areas (ESAs). The
Department conducted a review and has concluded that the property DOES NOT contain
Environmentally Sensitive Areas. However, future proposals will be subject to a new ESA
review and conditions may be added if new ESAs are found on the property.
2.) The applicant is proposing to create or add 240 square feet of impervious surface.
Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that
your proposal adhere to Best Management Practices (BMPs)to control sediment and
erosion on the property.
3.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
4.) The site plan as submitted with the building application on 6/11/02 has been reviewed for
consistency under the UDC, and has been approved by Jefferson County Department of
Community Development. Any modifications, changes, and/or additions to the stamped,
approved site plan dated 6/25/02 shall be resubmitted for review and approval by
Jefferson County Department of Community Development.
5.) This approval is for a deck only. Any future permits on this site are subject to review for
consistency with applicable codes and ordinances and does not preclude review and
conditions which may be placed on future permits.
6.) The existing dwelling is located off of Montgomery Street, which is classified as a local
access road. The front porch/landing is currently located 18-feet from the front lot line
abutting Montgomery Street. The proposed deck will stay consistent with the 18-foot
established setback and will not further encroach on the local access road.
7.) The proposed deck will be constructed flush with the existing deck and located
approximately 18-feet from the front lot line and 38-feet from the existing paved portion of
Montgomery Street.
8.) The applicant shall construct the deck addition flush with the existing deck located along
the western lot line. The distance will be approximately 18-feet from the front lot line to
the deck. The expansion is defined by Section 4.26(2)(b)(1) of the Unfied Development
Code. The proposed expansion is less than 10% and is classified as a legal non
conforming use.
9.) The proposal will not increase the non conformity of the building nor locate any portion of
the proposal closer to the lot line then already exists.
10.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined by the amount of
impervious surface which includes roof tops, driveways, sidewalks, decks, etc.
11.) The building height is not to exceed 35 feet.
12.) Montgomery Road is classifed as a local access road and requires a minimum 18-foot
front yard setback (already established), 5-foot side yard and rear setbacks.
