The application was reviewed by the Jefferson County Department of Community Development staff on July 1, 2002 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Susceptible Aquifer Recharge Area, Fish &Wildlife (Heron & Osprey). 2.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 4.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 5.) Washington State Department of Fish &Wildlife commented on the application on July 9, 2002 and found the proposal to be no conflict with Fish &Wildlife habitat. 6.) A minimum of two (2) on-site parking spaces are required for the single family residence. 7.) The building height is not to exceed 35 feet. 8.) Maximum lot coverage is not to exceed 45%. Lot coverage is defined as amount of impervious surface which includes rooftops, ddriveways, concrete, etc. 9.) Minimum setback from Ludlow Bay Rd is 20 feet. Minimum setback from the northern property line is 20 feet. Minimum setback from the western property line is 20 feet. Minimum setback from the eastern property line is 5 feet. 10.) This parcel is a legal conforming lot that has been designated as Single Family -4 Dwelling Units Per Acre (MPR-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Maps effective August 28, 1998. 11.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 12.) This parcel was created through the Bayside Short Plat subdivision on July 17, 1990 and recorded under AFN 332715, Vol 2, pp 157-158 of Short Plats. 13.) The applicant is proposing to create or add 7,660 square feet of impervious surface and 2,600 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. 14.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 15.) Per Section 3.107 of the Port Ludlow Master Planned Resort Code, Accessory dwelling Units are not allowed in the MPR-SF zone. 16.) Ludlow Bay Rd (C508209) is a county local access road. The road approach was reviewed under RAP02-00149. An address of 301 Ludlow Bay Rd has been assigned to the parcel. 17.) Per the Bayside Short Plat, Lots 1, 2, 3 and 4 of the Bayside Short Plat, and Tract 14 of Ludlow Beach Tracts, recorded in Volume 3 of Plats, p 27, Jefferson County, Washington, are subject to an Easement and Road Maintenance Agreement, which has been recorded under Jefferson County Auditor's No 331089. 18.) A ten (10) foot waterline easement exists along the western property line. I 19.) Per Bayside Short Plat plat conditions, Vegetation Height Restrictions are as follows: No trees or other vegetation, now existing or subsequently placed shall be allowed to exceed a height of either (1)thirty (30)feet; or (2)the highest point on any dwelling unit on a lot, whichever is lower. 20.) Per Bayside Short Plat plat conditions, the owners of lots 1, 2, 3, and 4 of Bayside Short Plat shall be required to maintain the storm drainage system and storm drainage easment. 21.) The site plan as submitted with the building application on July 24, 2002 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 24, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 22.) This approval is for a single family residence with attached garage only.
