1.) The application was reviewed by the Jefferson County Department of Community
Development staff on July 8, 2002 for the potential presence of Environmentally Sensitive
Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an
initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
Shoreline (Conservancy), Fish &Wildlife (Eagle).
2.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat
management plan dated February 9, 2002. As per the approved Eagle Plan received
dated February 9, 2002, the applicant shall retain all known perch trees and conifers
>1=24 inches diameter at breast height(d.b.h.). The applicant shall also retain >/=50% of
pre-clearing or pre-construction conifer stand with diameter distributions representative of
the original stand (>6 feet tall). Windowing and low limbing of trees is acceptable provided
no more than 30% of the live crown is removed.
3.) A Special Report was submitted in conjunction with the application to address Eagle
habitat. Washington State Department of Fish &Wildlife commented on the application
August 1, 2002 and determined an eagle plan is required. A Bald Eagle Management
Plan dated February 8, 2002 was provided to the Department of Community Development
office on July 23, 2002.
4.) The applicant is proposing to create or add 720 square feet of impervious surface and
2,400 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson
County Unified Development Code requires that your proposal adhere to Best
Management Practices (BMPs).
5.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
6.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
7.) Maximum lot coverage is not to exceed 25%.
8.) The building height is not to exceed 35 feet.
9.) Minimum setback from the edge of the easement for N Bay Way is 20 feet. Minimum side
setbacks are 5 feet. Minimum setback from the top of the shoreline bank is 65 feet.
10.) The building permit application as submitted by the applicant on July 26, 2002 identified
the shoreline bank height at 65 feet. The standard setback for residential structures,
including common appurtenant structures such as garages and workshops, shall be thirty
(30) feet or one (1) foot for each foot of bank height, whichever is greater. This setback
shall be measured from the bank's edge when the bank's height exceeds 10 feet. When
the bank's height is less than 10 feet, the setback shall be measured from the ordinary
high water mark. The setback shall not exceed 100 feet. Therefore, minimum setback
from the bank's edge is 65 feet.
11.) The proposal is to develop across separate parcels (921 292 003 and 921 292 004).
Setback requirements will not allow for the development (residence, septic and garage) to
span over lot lines. A Declaration of Restrictive Covenant recorded with the Jefferson
County Auditors Office shall be required.
12.) These legal non-conforming parcels have been designated as Rural Residential 1:5 under
the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998.
13.) N Bay Way (P5067) is a private road. A road approach permit is not required, and an
address of 540 N Bay Way has been assigned to the parcel.
14.) An easement for primary and reserve drainfield was recorded on January 21, 1993 under
AFN 356775.
15.) The revised site plan as submitted with the building application on October 10, 2002 has
been reviewed for consistency under the UDC, and has been approved by Jefferson
County Department of Community Development. Any modifications, changes, and/or
additions to the stamped, approved site plan dated October 10, 2002 shall be resubmitted
for review and approval by Jefferson County Department of Community Development.

16.) This approval is for a garage with office only. Any future permits on this site are subject to
review for consistency with applicable codes and ordinances and does not preclude
review and conditions which may be placed on future permits.
