The application was reviewed by the Jefferson County Department of Community Development staff on July 17, 2002 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: FLOOD ZONE A- DUCKABUSH RIVER; EROSION HAZARD AREA APPROX. 50 % OF PROPERTY; LANDSLIDE HAZARD AREA ON PORTION OF PROPERTY IMMEDIATELY NORTH OF RIVER; WILDLIFE HABITAT CONSISTING OF BREEDING AREA FOR HARLEQUIN DUCK&SPOTTED OWL HABITAT ON ENTIRE SITE; TYPE 1 STREAM -DUCKABUSH RIVER; TYPE 5 STEAM AS TRIBUTARY TO RIVER THAT FLOWS SOUTHERLY NEAR THE CENTER OF THE PROPERTY; AND CONSERVANCY SHORELINE DESIGNATION ALONG DUCKABUSH RIVER.. 2.) The property features an Erosion Hazard Area. The applicant has submitted a Small Parcel Erosion and Sediment Control Plan. The applicant is proposing to create or add 3600 square feet of impervious surface and 6064 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a SPESCP. 3.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 5.) A geotechnical report was not required or submitted for the single family residence. 6.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer depicted on the"Preliminary Site Plan"submitted December 31, 2001 shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 7.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. 8.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 9.) Among the native conifer species which may be used in buffers or for re-vegetation include, but are not limited to: Grand Fir(Aibes grandis), Sitka Spruce (Picea Sitchensis), Shore Pine(Pinus Contorta), Douglas Fir(Pseudotsuga Menziesii), Western Red Cedar (Thuja Plicata), and Western Hemlock(Tsuga Heterophylla). Among native tree species which may be used includes: Vine Maple (Acer Circinatum), Big-Leaf Maple (Acer Macrophyllum), Red Alder(Alnus Rubra), Pacific Madrone (Arbutus Menziesii), Quaking Aspen (Populus Tremula), Black Cottonwood (Populus Trichocarpa), Bitter Cherry (Prunus Emarginata), Oregon White Oak(Quercus Garryana), Cascara (Rhamnus Purshiana), Pacific Willow(Saliz Lasiandra), and Scouler's Willow(Saliz Scouleriana). Among the native shrub species which may be used are: Sevice-Berry (Amalanchier Alnifolia), Red Osier Dogwood (Cornus Stolonifera) Salal (Gaultheria Shallon), Ocean Spray (Holodiscus Discolor), Indian Plum (Oemlaria Cerasiformis), Pacific Ninebark (Physocarpus Capitus), Red Flowering Currant(Ribes Sanguineum), Wild Rose (Rosa Nutkana), Swamp Rose (Rosa Pisocarpa), Willows (Salix ssp.), Red Elderberry (Sambucus Racemosa), Snowberry (Symphoricarpos Albus), Evergreen Huckleberry (Vaccinium Ovatum), Red Huckleberry (Vaccinium Parvifolium). 10.) All construction activities shall not encroach upon either the 50 foot buffer or the 150 foot buffer. This includes the storage or preparation of materials. 11.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 12.) The identified Fish and Wildlife Habitat Area (Type 5 Stream), shall maintain a vegetative buffer setback of 50 feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM) to the proposed single family residence. 13.) An additional setback of five (5) feet is required from the edge of the buffer area to the proposed single family residence. 14.) The identified Fish and Wildlife Habitat Area (Type 1 Stream - Duckabush River), shall maintain a vegetative buffer setback of 150-feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM) to the proposed single family residence. 15.) An additional setback of five (5)feet is required from the edge of the 150 foot river buffer area to the proposed single family residence. 16.) The development shall assure that surface water runoff does not pollute adjacent waters or cause soil or beach erosion, either during or after construction. 17.) A Type (1) Stream ( Duckabush River-Fish and Wildlife Habitat Area) has been identified on the subject property. The stream will require a setback of 155-feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established. 18.) A Type (5) Stream ( Seasonal Stream tributary to Duckabush River-Fish and Wildlife Habitat Area) has been identified on the subject property. The Type 5 stream will require a setback of 50-feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established. 19.) Permanent physical separations along the boundary of the buffer areas shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 20.) Stream Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100)feet, whichever is less. Signs shall be in place prior to and during construction activities. The signs shall contain the following statement: "Buffer - Do Not Remove or Alter Existing Vegetation." 21.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. • 22.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 23.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 24.) All trees and understory lying outside of road rights-of-way and utility easements shall be retained (except for hazard trees)during clearing for roadways and utilities, provided that understory damaged during approved clearing operations may be pruned. Damage to vegetation retained during initial clearing activities shall be minimized by directional felling of trees to avoid critical areas and vegetation to be retained. Activities and improvements which do not significantly affect the function of the Fish and Wildlife Habitat Area or Stream Buffer(s) (including viewing structures, outdoor scientific or interpretive facilities, trails, etc) may be permitted in Fish and Wildlife Habitat Areas or Stream Buffers. Trails and other activities shall be planned to minimize removal of trees, shrubs, snags and important wildlife habitat. 25.) Viewing platforms, interpretive areas, benches and access to them, shall be designed and located to minimize impacts to wildlife, fish, or their habitat and/or critical characteristics of the affected conservation area. Trails, in general, shall be set back from stream so that there will be minimal impact to the stream from trail use or maintenance. Trails shall be constructed with pervious surfaces when feasible and trails within the Fish and Wildlife Habitat Area are not intended to be used by motorized vehicles. 26.) Chemical applications are not permitted with the Fish and Wildlife Habitat Area unless expressly approved as part of a farm plan, forest practices application, or for the control of invasive or noxious plant species. In cases where approved chemical applications occur as part of a forest practices application, proper reporting procedures shall be followed. Chemical storage shall not be permitted in a the Fish and Wildlife Habitat Area or the Stream Buffers. 27.) No land use or development activity, even if the activity does not require a permit, shall be allowed that alters the function or character of the Fish and Wildlife Habitat Area or its buffers. This includes, but is not limited to activities involving: (1)The removal, excavation, grading, dumping, discharging, or filling of any material unless part of a project which has been permitted pursuant to the Jefferson County Unified Development Code. (2)The destruction or alteration of the Fish and Wildlife Habitat Area or its buffers through clearing, grading, harvesting, shading, intentional burning, vegetation removal or planting of vegetation that would alter the character of the Fish and Wildlife Habitat Areas or its buffers, unless part of a project which has been permitted pursuant to the Jefferson County Unified Development Code. 28.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500) feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 29.) The parcel is a legal non-conforming lot that is designated as RR 1:20 under the Jefferson County Comprehensive Plan Land Use Map effective 8/28/1998. 30.) This approval is for a Single Family Residence only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 31.) The site plan as submitted with the building permit application on July 11, 2002 has been reviewed for consistency under the UDC. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan date stamped July 18, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 32.) Maximum Impervious Surface Area shall not exceed 25 percent. 0 • 33.) Minimum setback from the east property line (the private access road easement) shall be 20 feet. Minimum setback from the north property line shall be 5 feet. Minimim setback from the ordinary high water mark of the Duckabush River shall be 155 feet.
