The application was reviewed by the Jefferson County Department of Community Development staff on July 29, 2002 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Slight(level 1) Landslide Hazard Area &Osprey Nest/Habitat. 2.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 3.) A geotechnical report was not required or submitted for the single family residence building permit. 4.) A Road Approach Permit(RAP02-00065)was issued April 24, 2002 for the property, subject to conditions. 5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 6.) The parcel is a legal conforming lot that is designated as Single Family -4 dwelling units per acre (MPR-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Map, effective 8/28/1998. 7.) If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Adiminstrator shall be notified at once. 8.) This approval is for a single family residence only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 9.) The site plan as submitted with the building permit application on July 16, 2002 was Revised July 31, 2002 and has been reviewed for consistency under the UDC. The revised site plan has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved revised site plan dated July 31, 2002 and approved August 16, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) Maximum Impervious Surface Area for the lot shall not exceed 45 percent. 11.) Minimum setback from the Dunsmuir Road right-of-way line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 12.) The building height shall not exceed 35 feet. 13.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, accessory dwelling units shall not be allowed in the MPR-SF zone. 14.) The applicant is proposing to create or add 4350 square feet of impervious surface and 4500 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a SPESCP on July 31, 2002. 15.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 16.) The applicant proposes to pipe runoff water into the County Road Ditch at 2 points. There are no approved storm water facilities for this plat. Runoff may be directed to the County Road Ditch; However, no pipes or curtain drains may be constructed within the Dunsmuir Road Right-of-Way without a permit fro the Department of Public Works. The Washington State Department of Fish and Wildlife reviewed the for potential proposal impacts to osprey in a August 16, 2002 e-mail. The existing level of development, the topography, and the distance from the nest indicate that this proposal will only have a "minimal impact"to Osprey and/or Great blue heron. However, retention of the mature conifer trees should be encouraged to provide a visual screen as well as future perching and/or nesting habitat. 18.) The applicant determined the location of the front property line by measuring 30 feet from the center line of street(Dunsmuir Rd). Jefferson County does not attest to the accuracy of this method of determining property lines.
