SPECIAL CONDITIONS FOR CASE BLD02-00479
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on August 29, 2002 for the potential presence of Critical Areas (CAs)
under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following CAs were confirmed to be present on the subject property: Great
blue heron rookery.
2.) During SEPA environmental review for the Plat of Timberton Village, Washington State
Department of Fish and Wildlife Area Habitat Biologist Tim Rymer conducted a field
evaluation to determine the presence of a fish and wildlife habitat area on the subject
property. Mr. Rymer and other Department of Fish and Wildlife personnel concluded that
the suspected Great blue heron rookery was not located as mapped in the Jefferson
County Critical Areas Ordinance, but, that it was in fact located in the NE Quarter of the
NW Quarter of Section 20, Township 28 North, Range 1 East, which is approximately 1/2
mile south of the project site.
3.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
4.) The parcel is a legal conforming lot that is designated as Single Family -4 dwelling units
per acre (MPR-SF 4:1) under the Jefferson County Comprehensive Plan Land Use Map
effective August 28, 1998.
5.) This approval is for a Single Family Residence with Attached Garage only. Any future
permits on this site are subject to review for consistency with applicable codes and
ordinances and does not preclude review and conditions which may be placed on future
permits.
6.) The site plan as submitted with the building permit application on August 21, 2001 has
been reviewed for consistency under the MPR Code. It has been approved by Jefferson
County Department of Community Development. Any modifications, changes, and/or
additions to the stamped, approved site plan dated September 4, 2002 shall be
resubmitted for review and approval by Jefferson County Department of Community
Development.
7.) Lot 76 was created through the subdivision of Timberton Village Phase III on August 29,
2001and recorded under Auditor's File Number 447260 and filed in Volume 7 Page 144 of
Plats, records of Jefferson County.
8.) The applicant is proposing to create or add 2925 square feet of impervious surface and
3000 square feet of land disturbing activities. Plat conditions and Section 4.1 of the
Jefferson County Stormwater Management Ordinance that your proposal submit a Small
Parcel Erosion and Sediment Control Plan.
9.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by
the Department of Community Development. Once the subject permit has been issued
the applicant shall fully implement the provisions of the submitted plan and contact the
Jefferson County Department of Community Development to arrange a schedule to
inspect the property for plan compliance. A Certificate of Occupancy will not be issued
until the Department verifies plan compliance. No clearing for roadways or utilities shall
occur on the project site until clearing necessary for the installation of temporary
sedimentation and erosion control measures have been completed.
10.) The southwest corner of lot 76 is adjacent to a wetland buffer located within Tract"J"of
the Plat of Timberton Village Phase III.
11.) All construction activities shall not encroach upon the wetland buffer. This includes the
storage or preparation of materials.
12.) Disturbance of vegetation within any area with a combination of slopes greater than 15
percent with impermeable or slowly impermeable soils, ground water seepage, or
potentially unstable slopes, the following conditions shall apply: A) Whenever feasible,
existing vegetation in these areas shall remain in an undisturbed condition; B) If the area
is unvegetated due to a previous disturbance, immediate efforts shall be required to
provide a persistent native vegetative cover to prevent erosion or hazard; C) In order to
minimize impacts to environmentally sensitive areas and on site vegetation, authorized
clearing shall be designed to minimize impacts to soil and under story vegetation by
providing for sequencing and staging where appropriate.

13.) In the event archaeological items are discovered during construction, builders and lot
owners shall observe the following protocol: Stop Work, do not further disturb the area or
remove any materials therefrom. Notify immediately the Director of Community
Development(360) 379-4450. The Director of Community Development will immediately
notify the Washington State Office of Archaeology and Historic Preservation ("OAHP"),
(360)407-0752. Protect the area from vandals and collectors. Obtain services of a
qualified archaeologist to evaluate the site and make recommendations for further work in
the area. If further excavation or disturbance of the site is necessary, obtain the
appropriate permit from OAHP. Proceed only in compliance with the terms and conditions
of said permit.
14.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, accessory
dwelling units shall not be allowed in the MPR-SF zone.
15.) Based on Table MPR-SF of the Port Ludlow Master Planned Resort Code, the maximum
impervious surface for lot 76 shall be 45 percent.
16.) Minimum setback from Vistawood Court-a private road (Tract G) property line shall be 20
feet. Minimum side and rear yard setbacks shall be 5 feet.
17.) The building height shall not exceed 35 feet.
18.) The applicant submitted a Summary Letter dated April 25, 2001 from GeoResources, who
prepared the 1997 Geotechnical Report. The summary letter verified that the
recommendations of the 1997 report have been met to the satisfaction of the professional
engineer who prepared the report.
