HomeMy WebLinkAbout30-0512-25R STATE OF WASHINGTON County of Jefferson A Resolution Amending the Fee Schedule for the Department of Public Works, RESOLUTION NO. 30-0512-25R Solid Waste Division WHEREAS, Jefferson County is a political subdivision of the state of Washington as provided by Title 36 RCW and the Washington State Constitution Article 1 1, and may impose fees to recoup the costs of providing services to the public; and, WHEREAS, the Board of County Commissioners may impose fees charged by the Department of Public Works, Solid Waste Division ("Solid Waste Division") to implement the code and statutory duties; and, WHEREAS, JCC 3.80.020 authorizes the Solid Waste Division to request adoption of its fee schedule by resolution;and, WHEREAS, the Board of County Commissioners adopted a revised Solid Waste Division fee schedule by Resolution 28 23 on July 3, 2023; and, WHEREAS, Resolution 28 23 set a benchmark for a reserved capital fund balance of 25%of current capital replacement value; and, WHEREAS,the projected year-end capital fund balance of$453,443 is an estimated $1.8M less than the fund benchmark; and, WHEREAS,the projected year-end capital fund balance of$453,443 is an estimated $3.1 M less than the estimated cost of transfer station infrastructure repair and replacement needs; and, WHEREAS, failure to address critically needed transfer station infrastructure repair and replacement will cause unplanned service interruptions; and, WHEREAS, Solid Waste Division staff presented analysis and discussed these issues with the Board of County Commissioners and the Solid Waste Advisory Committee on March 26, 2025, and again on April 29, 2025; and, WHEREAS,Public Works staff has recommended the adoption of a"Capital Surcharge" to be applied to the current per ton fee charged at the transfer station in order to fund transfer station infrastructure repair and replacement, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON COUNTY, STATE OF WASHINGTON: Section 1. Whereas Clauses Adopted as Findings of Fact. The Jefferson County Board of Commissioners hereby adopts the above "Whereas"clauses as Findings of Fact. Section 2. Purpose. The purpose of this resolution is to: 1) revise the pre-tax base per ton fee for garbage disposal collected at the Transfer Station scales from one hundred sixty-five dollars and twenty-three cents($165.23)to one hundred eighty dollars and twenty-three cents($180.23) 2) reduce the minimum fee weight from two hundred forty (240)pounds to two hundred twenty (220)pounds 3) set aside fifteen dollars and no cents ($15.00)per ton of every municipal solid waste transaction at the Transfer Station,excluding yard debris, in a separate Solid Waste capital account to be used for facility and equipment capital purchases,repairs, replacements, and/or improvements. Severability. If any section, subsection, sentence, clause,phrase of this resolution or its application to any person or circumstance is held invalid, the remainder of this resolution or its application to other persons or circumstances shall be fully valid and shall not be affected. Section 4. Effective Date. This resolution is effective upon August 1, 2025. Section 5. SEPA Categorical Exemption. Analysis/Strategic Goals/Pro's 8 Con's: This issue was discussed at special joint meetings of the Solid Waste Advisory Committee and Board of County Commissioners (BoCC) on March 26, 2025 and April 29, 2025. Staff stressed that inaction would lead to unexpected service interruption as critical equipment failed and funding was inadequate to affect repairs or replacement. Staff recommended that a "Capital Surcharge" of $15.00 be added to the pretax per ton rate which would be set aside in the Equipment Reserve (Capital) account to be used for facility and equipment capital purchases, repairs, replacements, and/or improvements. Staff additionally recommended lowering the minimum fee weight threshold from 240 pounds to 220 pounds in order to equitably distribute customer contribution to capital needs. At the April 29, 2025 special meeting a SWAC motion passed to recommend to the BoCC the adoption of the capital surcharge and revise the minimum fee weight as recommended by staff and the BoCC agreed with this recommendation. Fiscal Impact/Cost Benefit Analysis: The additional funding will position Public Works to receive and repay or match loans and/or grants from sources such as the Public Works Board.
