The application was reviewed by the Jefferson County Department of Community Development staff on 9/24/02 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Osprey Nest. 2.) The Washington State Department of Fish and Wildlife Area Habitat Biologist reviewed the above referenced finding and offered the following comment: The existing level of development, the topography, and the distance from the nest indicate that this proposal will not have a significant impact on the Osprey. However, retention of the mature conifer trees should be encouraged to provide a visual screen as well as future perching and/or nesting habitat. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 4.) The parcel is a legal non-conforming lot that is designated as Single Family (MPR-SF [4:1] under the Jefferson County Comprehensive Plan Land Use Map effective 8/28/98. 5.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The site plan as submitted with the building permit application on September 12, 2002 has been reviewed for consistency under the Port Ludlow Master Planned Resort Code. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated September 24, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) The applicant is proposing to create or add 2038 square feet of impervious surface and 2038 square feet of land disturbing activities. Section 4.1 of the Jefferson County Stormwater Ordinance requires that your proposal submit a Stormwater Calculation Sheet. The applicant submitted a Stormwater Calculation Sheet. 8.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 9.) Maximum Lot Impervious Surface Area shall not exceed 45 percent. 10.) Minimum setback from Puget Loop right-of-way line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 11.) The building height shall not exceed 35 feet. 12.)
