SPECIAL CONDITIONS FOR CE BLD02-00614
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on 10/23/02 for the potential presence of Environmentally Sensitive
Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an
initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
Level 1 Landslide Hazard Area and Great blue heron Rookery.
2.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type,
geologic material, and groundwater that may combine to create problems with slope
stability, erosion, and water quality during and after construction or during natural events
such as earthquakes or severe rainstorms.
3.) A Geotechnical Report dated January 15, 1997 was prepared for the Timberton Village
Phase III Plat. It is on file with the Jefferson County Department of Community
Development Office. The report contains information and recommendations relating to
site work, construction activities and related matters associated with soils and slope
stability. All construction and clearing activities on any lot within the plat are required to
comply with the recommendations set forth in the report or comply with the
recommendations of an approved alternative geotechnical/engineering report.
4.) The applicant submitted the following documentation to verify that the lot will be developed
in accordance with the recommendations of the approved January 15, 1997 Geotechnical
Report-Summary letter dated April 25, 2001 from GeoResources, who prepared the 1997
Geotechnical Report.
5.) During SEPA environmental review for the plat of Timberton Village, WDFW Area Habitat
Biologist Tim Rymer conducted a field evaluation to determine the presence of a fish and
wildlife habitat area on the subject property. Mr. Rymer and other WDFW personnel
concluded that the suspected Great Blue Heron rookery was not located as mapped in the
Jefferson County Critical Area Ordinance, but, that it was in fact located in the NE Quarter
of the NW Quarter of Section 20, Township 28 North, Range 1 East, which is
approximately 1/2 mile south of the project site.
6.) The applicant is proposing to create or add 3356 square feet of impervious surface and
3356 square feet of land disturbing activities. Plat conditions and Section 4.1 of the
Jefferson County Storm Water Management Ordinance requires that your proposal submit
a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a SPESCP.
7.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by
the Department of Community Development. Once the subject permit has been issued
the applicant shall fully implement the provisions of the submitted plan and contact the
Jefferson County Department of Community Development to arrange a schedule to
inspect the property for plan compliance. A Certificate of Occupancy will not be issued
until the Department verifies plan compliance. No clearing for roadways or utilities shall
occur on the project site until clearing necessary for the installation of temporary
sedimentation and erosion control measures have been completed.
8.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i).
9.) This approval is for a Single Family Residence with attached garage only. Any future
permits on this site are subject to review for consistency with applicable codes and
ordinances and does not preclude review and conditions which may be placed on future
permits.
10.) The subdivision plat of which lot 65 if part of was approved by the Jefferson County Board
of Commissioners in July 2001 and recorded August 29, 2001 with the Auditor's Office
under AFN 447260, Volume 7, Page 144 of plats.
11.) The parcel is a legal conforming lot that is designated Single Family -4 Dwelling Units per
Acre (MPR-SF) under the Jefferson County Comprehensive Plan Land Use Map effective
8/28/1998.
12.) Maximum Impervious Surface Area of lot 65 shall not exceed 45 percent.
13.) Minimum setback from Timber Heights Drive right-of-way line shall be 20 feet. Minimum
side and rear yard setbacks shall be 5 feet.
14.) The building height shall not exceed 35 feet.
15.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, accessory
dwelling units (ADU) shall not be allowed in the MPR-SF zone.

16.) For disturbance of vegetation many area with a combination of slopes greater than 15
percent with impereable or slowly impereable soils, ground water seepage, or potentially
unstable slopes, the following conditions shall apply: a) Whenever feasible, existing
vegetation in these areas shall remain in an undisturbed condition; b) If the area is
unvegetated due to a previous disturbance, immediate efforts shall be required to provide
a persistent vegetative cover to prevent erosion or hazard; c) In order to minimize impacts
to environmentally sensitive areas and on site vegetation, authorized clearing shall be
designed to minimize impacts to soil and under story vegetation by providing for
sequencing and staging where appropriate.
17.) In the event archaelogical items are discovered during construction, builders and lot
owners shall observe the following protocol: Stop Work; Do Not Further Disturb the Area
or Remove and Materials Therefrom; Notify immediately the Jefferson County Director of
Community Development at 360-379.4450. The Director of Community Development will
immediately notify the Washington State Office of Archaeology and Historic Preservation
(OAHP), 360-407-0752. Protect the area from vandals and collectors. Obtain the services
of a Qualified Archaeologist to evaluate the site and make any recommendations for
further work in the area. If further excavation or disturbance of the site is necessary,
obtain the appropriate permit from OAHP, proceed only in compliance with the terms and
conditions of said permit.
