STATEMENT OF ISSUE:
The County adopted Ordinance 03-0311-19 in March,2019 to establish biennial budgeting in Jefferson
County.After having promulgated three successive biennial budgets the County Budget Committee voted
to revert to annual budgeting.
ANALYSIS:
Counties with biennial budgets may revert to annual budgets at the end of a biennial budget period
pursuant to RCW 36.40.250 by repealing the enacting ordinance.The repealing ordinance must be
considered by the legislative authority in a properly noticed public hearing. The attached hearing notice
will meet the public notice requirement.
FISCAL IMPACT:
None.
RECOMMENDATION:
Approve the attached hearing notice.

Biennial Budget)
NOTICE IS HEREBY GIVEN that a public hearing has been set by the Jefferson County Board of
Commissioners for MONDAY, June 2,2025 at 10:15 a.m. in the Commissioners' Chambers,County
Courthouse, 1820 Jefferson Street, Port Townsend, WA 98368. Notice of said public hearing is to be
published in the official newspaper of Jefferson County.
The County adopted Ordinance 03-0311-19 in March,2019 to establish biennial budgeting in Jefferson
County. After having promulgated three successive biennial budgets the County Budget Committee voted to
revert to annual budgeting.

In the Matter of Repealing Ordinance 03-
0311-19 and Chapter 3.01 Jefferson County ORDINANCE NO.
Code (Biennial Budget)
WHEREAS, Article XI, section 11 of the Washington Constitution, confers upon county
legislative authorities the police power to adopt such local police, sanitary and other regulations
as are not in conflict with general laws; and,
WHEREAS, Article XI, section 11 of the Washington Constitution is a direct delegation
of the police power to cities and counties, and the power delegated is as extensive within their
sphere as that possessed by the legislature; and,
WHEREAS, police power is that inherent and plenary power which enables prohibition of
all things hurtful to the comfort, safety and welfare of society;and,
WHEREAS, the scope of police power is broad, encompassing all those measures which
bear a reasonable and substantial relation to promotion of the general welfare of the people;and,
WHEREAS, Jefferson County,on March 11, 2019,adopted Ordinance 03-0311-19 which
was codified as Jefferson County Code(JCC) Chapter 3.01 (Biennial Budget); and,
WHEREAS, after having promulgated three successive biennial budgets; and,
WHEREAS, the County Budget Committee voted to revert back to annual budgets; and,
WHEREAS, RCW 36.40.250 allows counties to revert to annual budgeting by repealing
the ordinance establishing biennial budgeting;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF JEFFERSON COUNTY, STATE OF WASHINGTON, AS
FOLLOWS:
Section 1. Whereas Clauses are Findings of Fact. The Jefferson County Board of Commissioners
hereby adopts the above "Whereas" clauses as Findings of Fact supporting this ordinance.
Section 2. Purpose. Pursuant to the authority granted in RCW 36.40.250 the purpose of this
ordinance is to repeal Ordinance 03-0311-19 which established biennial budgeting in Jefferson
County and Chapter 3.01 JCC (Biennial Budget), where Ordinance 03-0311-19 is codified.
Section 3. Severability. If any section, subsection, sentence, clause, phrase or section of this
Resolution or its application to any person or circumstance is held invalid, the remainder of this
Resolution or its application to other persons or circumstances shall be fully valid and shall not be
affected.
Section 4. SEPA Categorical Exemption. This Ordinance is categorically exempt from the State
Environmental Policy Act under WAC 197-11-800 (19).
Section 5. Effective Date. This Ordinance shall take effect and be in full force immediately upon
passage by the Board of County Commissioners.
