The application was reviewed by the Jefferson County Department of Community Development staff on November 22, 2002 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Fish &Wildlife (Osprey), Seismic. 2.) Washington State Department of Fish &Wildlife commented on the previous application (MLA02-00438/BLD02-00475) on August 28, 2002 and determined no conflict exists with the proposed development and osprey habitat. The development location proposed in this application is consistent with the site plan approved for MLA02-00438. He does make the following recommendations to protect osprey habitat: 1. Restrict all human activities within 201 m of any active osprey nest between April 1 and October 1. 2. Establish a "no cut"zone within 61 m of each nest. 3. Retain 3-5 live or dead dominant trees and young recruitment trees within 201 m of the nest tree. 4. Do not cut trees within 61 m around bodies of water associated with osprey nests. 5. Maintain two dominant live trees and two snags per acre within 335m of the"no cut" zone around bodies of water associated with osprey nests. 6. Preserve snags and live trees suitable for nesting for 3.2 km beyond the"restricted cutting"zone around water bodies associated with osprey nests. 7. Close roads between April 1 and October 1 if birds are unused to disturbance. 8. Do not apply chemicals to any watershed used by ospreys. 3.) Washington State Department of Fish &Wildlife commented on the previous application (MLA02-00438/BLD02-00475) on September 3, 2002 and determined the proposal is not in conflict with eagle habitat. 4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 6.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes rooftops, driveways, concrete, etc. 7.) The building height is not to exceed 35 feet. 8.) Minimum setback from Kelly Dr is 20 feet. Minimum setback from Thorndyke Rd is 20 feet. Minimum side and rear setbacks are 5 feet. These setbacks are to be measured from the property boundary or, if the road is on the parcel, the edge of the road. 9.) A minimum of two (2) on-site parking spaces are required for the single family residence. 10.) The applicant is proposing to create or add 2,100 square feet of impervious surface and 5,700 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal adhere to Best Management Practices (BMPs). 11.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 12.) This parcel has been designated as Rural Residential 1:5 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 13.) This parcel was created through the Cedarholm Villa Tracts subdivision on September 3, 1907 under AFN 25348, and modified under the Boundary Line Adjustment (SUB94-00036) survey recorded under AFN377227 on November 28, 1994. 14.) A Boundary Line Adjustment(SUB94-00036)was finaled on May 2, 1994 to create two lots from three in Cedarholm Villa Tracts. 15.) A septic permit(SEP02-00087)was approved April 25, 2002 for a system with capacity of 360 gallons per day. The cancelled permit applications (SEP94-00021 and SEP00-00237) are now filed with SEP02-00087. The associated critical area review (CAR00-00447)was withdrawn. 16.) Kelly Dr is a private road. A road approach permit is not required. An address of 65 Kelly Dr has been assigned to the parcel. 17.) A building permit(MLA02-00438/BLD02-00475) for a single family residence was approved September 18, 2002 and cancelled November 5, 2002 at the applicant's request. 18.) The site plan as submitted with the building application on November 5, 2002 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated November 22, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 19.) This approval is for a manufactured home installation only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 20.)
