The application was reviewed by the Jefferson County Department of Community Development staff on December 9, 2002 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Osprey Nest; Slight Landslide Hazard Area; and Susceptible Aquifer Recharge Area. 2.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 5.) A geotechincal report was prepared for the plat of Port Ludlow No. 7. The geotechnical report has been filed underJefferson County Recording No. 393727, together with an amendment filed under Jefferson County recording#406378. The report requires that lot development be conducted in conformance with the recommended conditions of the geotechnical report or an alternative geotechnical/engineering report prepared at the expense of the applicant. 6.) A Storm Report for Port Ludlow Division 7 (lots 2-8) dated July 24, 1996 and prepared by West Sound Engineering has been submitted and approved by the Jefferson County Department of Public Works on October 29, 1996. The report requires a roof downspout infiltration system for lot 7. The applicant proposes to install an approved roof downspout infiltration system per the approved Storm Report, which was filed under Auditor's File Number 395785. 7.) The Washington State Department of Fish and Wildlife Area Habitat Biologist visited the subject property. According to WDFW records, the subject property is located within 1/4 mile from the nearest osprey nest. During the site visit, no observations of nesting oprey were documented. Because the proposed activity is greater than 660-feet from any documented osprey nest, it is unlikely that the activity will impact the osprey located in the vicinity of the subject property. Therefore, the proposed development will not have any significant adverse impact on area osprey nest. 8.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin (see attached). 9.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 10.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 11.) The applicant is proposing to create or add 3102 square feet of impervious surface and 3102 square feet of land disturbing activities. Section 4.1 of the Jefferson County Storm Water Management Ordinance and Plat Condition requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and Sediment Control Plan. 12.) Temporary erosion control and storm water structures shall be inspected at least once per week during the construction period, and sediment shall be removed from sedimentation ponds as necessary to ensure proper functioning. Disposal of sediment materials shall be subject to the approval of the Jefferson County Department of Pubic Works in accordance with applicable federal, state, and county regulations. 13.) In order to avoid significant adverse impacts to soils and water, native vegetation in Tract A shall be maintained in an undisturbed condition. Pruning and limbing may be allowed to enhance views pursuant to the View Easement described on the face of the Subdivision Mylar. 14.) Some lots within this Plat might contain archaeological discoveries. If any items are discovered, lot owners should observe the following protocol (developed by a professional archaeologist in conjunction with local tribes): (1) Stop Work. Do not further disturb the area or remove any materials therefrom; (2) Notify immediately the Jefferson County Director of Community Development (360-39-79-4450); (3) Protect the area from vandals and collectors; (4) Obtain the services of a qualified archaeologist to evaluate the site and make recommendations for further work in the area; and (5) If further excavation or disturbance of the site is necessary, obtain the appropriate permit from the state Office of Archaeology and Historic Preservation [360-753-5010]. Proceed only in compliance with the terms and conditions of the permit. 15.) Construction within this Plat may be subject to work hour restictions designated and enforced by Jefferson County Department of Public Works. 16.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the approved submitted plan. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 17.) An application for a building permit(BLD02-0482) to construct a single-family residence with an attached garage was submitted 8/21/2002. It was withdrawn by the applicant in writing on August 27, 2002. 18.) An application has been made for a road approach permit(RAP02-00198)for the property was submitted August 21, 2002. 19.) The site plan as submitted with the building permit application on November 22, 2002 has been reviewed for consistency under the MPRC. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated November 22, 2002/December 9, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 20.) Maximum impervious surface area for lot 5 shall not exceed 45 percent. 21.) Minimum setback from the Wells Ridge Court right-of-way line shall be 20 feet. Minimum side yard and rear yard setbacks shall be 5 feet. 22.) The building height shall not exceed 35 feet. 23.)
