The application was reviewed by the Jefferson County Department of Community Development staff on 12/26/02 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Osprey Nest. 2.) The Washington State Department of Fish and Wildlife reviewed the site for potential impacts to a nearby Osprey Nest. WDFW determined that the proposed single family residence is greater than 1/2 mile from any active Osprey nest, and therefore, "should not have any significant impact on the nests."As usual, WDFW recommended retaining as many mature conifer trees as possible to protect existing and future perching, roosting, and/or nesting habitats. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 4.) The parcel is a legal conforming lot that is designated Single Family [4 Dwelling Units Per Acre] [MPR-SF 4:1] under the Jefferson County Comprehensive Plan Land Use Map effective 8/28/1998. 5.) This approval is for a Single Family Residence with Attached Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The site plan as submitted with the building permit application on December 20, 2002 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated December 20, 2002/December 26, 2002 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) Maximum impervious surface area for lot 37 shall not exceed 45 percent. 8.) Minimum setback from Falcon Lane right-of-way (a local access road) shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 9.) The building height shall not exceed 35 feet. 10.) Runoff from roof tops and driveway may be directed to the road ditch. However, no pipes or curtain drains may be constructed within the Falcon Lane right-of-way without a permit from the Jefferson County Department of Public Works. 11.) Based on Section 3.107 of the Port Ludlow Resort Code, accessory dwelling units shall not be allowed in the MPR-SF zone. 12.) The applicant is proposing to create or add 2692 square feet of impervious surface and 2692 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan for review and approval. The applicant submitted a Small Parcel Erosion and Sediment Control Plan. 13.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance.
