The application was reviewed by the Jefferson County Department of Community Development staff on January 14, 2003 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Great blue heron colony. 2.) The Washington State Department of Fish and Wildlife Area Habitat Biologist reviewed potential impacts from development of the lot. Their comments were"Due to the existing development and the fact that this is greater than 600-800 feet from the rookery, it should not have a significant impact to the great blue heron." 3.) The applicant is proposing to create or add 3356 square feet of impervious surface and 3116 square feet of land disturbing activities. Section 4.1of the Jefferson Storm Water Management Ordinance and Plat Conditions requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a Small Parcel Erosion and Sediment Control Plan. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 5.) This approval is for a Single Family Residence w/Attached Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The parcel is a legal conforming lot that is designated as Single Family 4:1 (MPR-SF) under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 7.) Maximum setback from Vista Wood Court(a private road -tract"G") property line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 8.) Maximum impervious surface area for lot 77 shall not exceed 45 percent. 9.) The building height shall not exceed 35 feet. 10.) Based on Section3.107 of the Port Ludlow Master Planned Resort Code, accessory dwelling units shall not be allowed in the MPR-SF zone. 11.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 12.) The applicant submitted a confirmation letter dated 4/25/2001 from GeoResources documenting that the recommendations in the January 15, 1997 Geotechnical Report have been completed satisfactorily. 13.) For disturbance of vegetation in any area with a combination of slopes greater than 15 percent with impermeable or slowly impermeable soils, ground water seepage, or potentially unstable slopes, the following conditions shall apply: 1)Whenever feasible, existing vegetation in these areas shall remain in an undisturbed condition; 2) If the area is unvegetated due_to a previous disturbance, immediate efforts whall be required to provide a persistent native vegetative cover to prevent erosion or hazard; 3) In order to minimize impacts to environmentally sensitive areas and on-site vegetation; 4) Authorized clearing shall be designed to minimize impacts to soil and understory vegetation by providing for sequencing and staging where appropriate. 14.) GeoResources and ADaPT Engineering, Inc.visited the site on an intermittent basis during earthwork activities, discussed earthwork activities with Seton Construction personnel and Mr. Ray Welch of Olympic Property Management, and reviewed the General Testing Field Reports(construction monitoring records, July 25 through September 25, 2000). In-place density tests were not performed on the fill material because of the percentage of plus%-inch material(as prescribed in ASTM). Based on our site observations during the project earthwork activities, review of the field documentation provided by General Testing and our discussions with site personnel, it is our opinion that the fill material placed in the roadways, utility trench backlit!and lot areas was placed in general accordance with the GeoEngineer's 1997 geotechnicai report for the site and the project plans and specifications. Localized field changes in grading were made during the advance of the project We we included in the proposed changes and provided input regarding the earthwork activities related to these changes. The subsequent earthwork activities were completed in accordance with our recommendations. Based on our site observations, data review and discussions with site personnel, it is our opinion that the project was completed In accordance with the gectechnical standards of practice in the Puget Sound area and in general accordance with the project plans and specifications. Start and complete land disturbing activities and stabilize the site between April 1 and September 30. Stabilization means that disturbed areas will have well-established plant cover or be landscaped to minimize erosion.
