The application was reviewed by the Jefferson County Department of Community Development staff on January 31, 2003 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: suburban shoreline designation; high risk coastal SIPZ. 2.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 3.) An Engineered Drainage& Erosion Control Report dated January 16, 2003 and prepared by Robert Leach, P.E. with Northwestern Territories Inc. has been submitted and approved by the Department of Community Development. Applicant and contractor shall fully implement the provisions and conditions of the submitted report. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 5.) This approval is for a single family residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The site plan as submitted with the single family residence permit application on January 23, 2003 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated February 7, 2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) The building height shall not exceed 35 feet. 8.) Minimum setback from West Ludlow Point Road shall be 20 feet. Minimum side yard setbacks shall be 5 feet. Minimum shoreline setback shall be 30 feet, or as in this case, a Building Setback Line (BSBL)was established through the subdivision process, therefore, all structures shall be constructed landward of this line. (Site plan depicts a 10' 10" setback from the BSBL to the proposed deck). 9.) Maximum lot coverage shall not exceed 45%. 10.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 11.) An address of 81 West Ludlow Point Road has been assigned to the parcel. West Ludlow Point Road is a county local access road (C509009). A road approach permit (RAP03-00015)will be issued by the County Public Works Department. 12.) The parcel was created through the Ludlow Point Village Division 1 on February 20, 1990 under AFN 328486. 13.) PRIOR TO ISSUANCE OF A FINAL BUILDING INSPECTION and consistent with MDNS dated October 4, 1988 and Shoreline Substantial Development Permit(SDP88-0016) dated September 2, 1988: The proponent shall enter into an agreement with the Washington State Department of Fisheries and Jefferson County to ensure that vegetative removal waterward of the residential setback line is consistent with the intent of Mitigative Measure 12 to preserve juvenile fish habitat and Policy 2 and Performance Standard 4 of Section 5.160, "Residential Development,"of the Master Program. 14.) High Risk SIPZ pertains to properties that utilize a well for potable water.
