The application was reviewed by the Jefferson County Department of Community Development staff on February 19, 2003 for the potential presence of Critical Areas (CAs) under the provisions of the Jefferson County Interim Critical Areas Ordinance (JCICAO). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following CAs were confirmed to be present on the subject property: Great Blue Heron Colony. 2.) During SEPA environmental review for the plat of Timberton Village, Washington State Department of Fish and Wildlife Area Habitat Biologist Tim Rymer conducted a field evaluation to determine the presence of a fish and wildlife habitat area on the subject property. Mr. Rymer and other Department of Fish and Wildlife personnel concluded that the suscepted Great Blue Heron Colony was not located as mapped in the Jefferson County Critical Areas Ordinance, but, that it was in fact located in the NE Quarter of the NW Quarter of Section 20, Township 28 North, Range 1 East, which is approximately 1/2 mile south of the project site. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 4.) This approval is for a Single Family Residence w/Attached Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 5.) The parcel is a legal conforming lot that is designated as Single Family (MPR-SF) -[4:1] under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 6.) The site plan as submitted with the Building Permit application on February 12, 2003 has been reviewed for consistency under the MPRCode. It has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated February 19, 2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) The proposed building lot(71) is within the Plat of Timberton Village Phase III, which was granted final plat approval and recorded August 29, 2001 under AFN 447260 with the County Auditor's Office. 8.) Maximum Impervious Surface Area shall not exceed 45 percent for lot 71. 9.) Minimum setback from Timberton Heights Drive right-of-way line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 10.) The building height shall not exceed 35 feet. 11.) Based on Section 3.107 of the Port Ludlow MPR Code, Accessory Dwelling Units shall not be allowed in the MPR-SF zone. 12.) For disturbance of vegetationin any area with a combination of slopes greater than 15 % with impermeable or slowly impermeable soils, ground water seepage, or potentially unstable slopes, the following conditions shall apply: a)Whenever feasible, existing vegetation in these areas shall remain in an undisturbed condition; b) If the area is unvegetated due to a previous disturbance, immediate efforts shall be required to provide a persistent native vegetation cover to prevent erosion or hazard; c) In order to minimize impacts to environmentally sensitive areas and on-site vegetation, authorized clearing shall be designed to minimize impacts to soil and understory vegetation by providing for sequencing and staging where appropriate. 13.) In the event archeological items are discovered during construction, builders and lot owners shall observe the following protocol: a) Stop work, do not further disturb the area or remove any materials therefrom; bloNotify immediately the Jefferson County Director of Community Development, (360-373-4450); c) The Director shall immediately notify the Washington State Office of Archaeology and Historic Preservation (OAHP) at 360-407-0752; d) Protect the area from vandals and collectors; e) Obtain the services of a qualified archaeologist to evaluate the site and make recommendations for further work in the area; f) If further excavation or disturbance of the site is necessary, obtain the appropriate OAHP permit; g) Proceed only in compliance with the terms and conditions of said permit. 14.) The applicant is proposing to create or add 2925 square feet of impervious surface and 2925 square feet of land disturbing activities. Section 4.1 of the Jefferson County Storm Water Management Ordinance and Plat Conditions requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan. The applicant submitted a SPESCP. 15.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance.
