Behind Closed Doors: Recent Cases Address Requirements for Executive Sessions During Special Meetings
Two recent state court of appeals decisions — West v. Walla Walla City Council (4/21/2025) and McFarland v. Tompkins (4/24/2025) — upheld the right of individuals to challenge OPMA violations
and to seek penalties for them. These cases involve similar fact patterns where executive sessions were convened during special meetings. In this blog I discuss some of the facts in
these cases and the OPMA requirements for noticing special meetings as well as for executive sessions.

Current and Future Development Focus of Adams County Commission Discussion
Adams County Commissioners discussed possible options for the design of a new evidence facility for the Adams County Sheriff's Office near Othello, but it was part of a wider-ranging
discussion about the future. County officials obtained funding for a building in 2021 and decided to build it on county-owned property adjoining the Othello Fairgrounds.

May 20-Yakima County took another step in its months-long coroner saga, appointing Marshall Slight to fill a position that's been vacant since his predecessor, Jim Curtice, stepped down

Paine Field Announces Steps Toward Commercial Terminal Expansion

Port of Chelan County Sues BNSF Railway for Easement Access
The Port of Chelan County is suing Great Northern Pacific and Burlington Lines, known as BNSF Railway, for easement access on a vacated part of Kittitas Street.
According to Jim Kuntz, Chelan Douglas Regional Port Authority CEO, the port has tried to obtain an easement from BNSF since the port purchased former freezer and fruit storage space
from Lineage Logistics in 2019. This purchase included 128,000 square feet in nine buildings — along Columbia Street, between Palouse Street, Orondo Avenue and the BNSF Railway. The
CDRPA was formed on Jan. 1, 2020, with the consolidation of the Port of Chelan County and Port of Douglas County; however, each of the ports' commissioners can take action separately
on issues.
