For your awareness, folks inside the Beltway are using various acronyms including OBBB, OBBBA, or OB3, which is our personal favorite, to reference the legislation. As a reminder, the House of Representatives passed its version of the reconciliation measure by a vote of 215-214-1 last month. This week, various Senate committees released their respective reconciliation provisions, and hearings should be scheduled soon. Those committees included Armed Services <https://watransit.us12.list- manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=32d297f322&e=7ccb4f03e2> ; Commerce, Science, and Transportation <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361& id=10d15862ed&e=7ccb4f03e2> ; and Environment and Public Works <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=28bb6ab9ff&e=7ccb4f03e2> . We expect that the Senate Committee on Banking, Housing, and Urban Affairs will release its provisions today, and other relevant committees should release the remaining provisions over the next week or two, although that timeline could certainly slip. The political process may prove more complicated for those other Senate committees as Senate Majority Leader John Thune attempts to placate competing factions within the Senate Republican Conference — with an awareness that any amendments must also be approved by a narrowly divided House overseen by Speaker Mike Johnson. Several GOP Representatives have indicated that they will withhold their support for the reconciliation measure if the Senate attempts to make significant changes after the House reached compromises on controversial issues like the cap on the State and Local Tax (SALT) deduction. Beyond potentially revisiting the SALT cap, other complicated questions that lawmakers will have to address include determining the depth of spending cuts (and whether or not to pursue further changes to Medicaid or touch Medicare and assessing whether or not to maintain any clean energy tax credits authorized by the Inflation Reduction Act (P.L. 117-169). It is certainly going to be an interesting summer ahead, if the platform formerly known as Twitter yesterday was any indication of the political conditions ahead. Permitting White House * Pursuant to the Presidential Memorandum entitled Updating Permitting Technology for the 21st Century, the White House Council on Environmental Quality (CEQ) issued <https://watransit.us12.list-mana ge.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=f919bb42f4&e=7ccb4f03e2> the Administration’s Permitting Technology Action Plan <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22 fe2ef2a8361&id=3089ab6927&e=7ccb4f03e2> . The Plan outlines a whole-of-government strategy to leverage technology in order to enhance the environmental review and permitting process for infrastructure projects. Key areas that the Plan will work to address include reliance on outdated systems, fragmented data management, and disconnected digital tools. The Plan provides minimum functional requirements for environmental review and permitting systems, an initial National Environmental Policy Act (NEPA) and permitting data and technology standard, a timeline and implementation roadmap, and an implementation governance structure. * The Administration’s new Permitting Innovation Center developed <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=b629fa53c1&e=7ccb4f03e2> its first new tool intended to streamline environmental reviews. The Categorical Exclusion (CE) Explorer <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=0964b0ce0e&e=7ccb4f0 3e2> provides a digitized and searchable public database of CEs established under NEPA available at each federal agency. The tool is designed for the use of project sponsors as well as federal agencies to enhance interagency coordination in permitting. Multimodal Implementation * The U.S. Department of Transportation (DOT) took a series of steps to advance the Administration’s deregulatory agenda for the Federal Highway Administration (FHWA), National Highway Traffic Safety Administration (NHTSA), Federal Motor Carrier Safety Administration (FMCSA), and Pipeline and Hazardous Materials Safety Administration (PHMSA).
