The application was reviewed by the Jefferson County Department of Community Development staff on April 28, 2003 for the potential presence of Environmentally Sensitive Areas (ESAs)under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Type 3 and Type 5 Streams; Fish in the Type 3 stream, Wetland areas; Seisimic Hazard Area; Landslide Hazard Area along west border;Zone"A" Flood Area along the Type 3 stream; and Susceptible Aquifer Recharge Area. 2.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Critical Aquifer Recharge Areas are defined as Seawater Intrusion Areas, and Special Aquifer Recharge Protection Areas and the following land uses located within Susceptible Aquifer Recharge Areas (1)All Industrial Land Uses (2)All Commercial Uses (3)All Rural Residential Land Uses requiring a Discretionary Use or Conditional Use Permit(4)All Rural Residential Land Uses with nonconforming uses that would otherwise require a Discretionary Use or Conditional Use Permit(5) Unsewered Planned Rural Residential Developments (6) Unsewered residential development with gross densities greater than one unit per acre. All of the above listed uses shall be subject to the applicable requirements and standards of the Jefferson County Unified Development Code. 5.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs)and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin (see attached). 6.) A setback of 75-feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing, or other alteration of the wetland or its buffer is allowed. 7.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100)feet,whichever is less. Signs shall contain the following statement: "Wetland & Buffer- Do Not Remove or Alter Existing Vegetation." 8.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500)feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry,you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies,fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period,the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 9.) A Type 3 Stream (Fish and Wildlife Habitat Area) has been identified on the subject property. The stream will require a setback of 500+-feet. The setback shall be measured horizontally from the Ordinary High Water Mark(OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established.A Type 5 Stream has been identified on the subject property. The Type 5 Stream requires minimum setback of 75-feet. The setback shall be measured horizontally from the Ordinary High Water Mark (OHWM). • 10.) Buffers are areas that shall b maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished. 11.) A setback of 500 +-feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing, or other alteration of the wetland or its buffer is allowed. 12.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100)feet, whichever is less. Signs shall contain the following statement: "Wetland & Buffer- Do Not Remove or Alter Existing Vegetation." 13.) A permanent physical separation along the upland boundary of the wetland buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 14.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 15.) A geotechnical report was not required or submitted for the single family residence building permit. 16.) This approval is for a Single Family Residence W/Attached Garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 17.) The parcel is a legal non-conforming lot that is designated as AG-20 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 18.) The property is subject to terms, conditions and restrictions under a Deed of Conservation Easement with the Jefferson Land Trust.The Deed of Conservation was recorded April 10,2000 with the Auditior under Auditor's File Number 432689. Specifically, the conservation easement protects approximately thirty(30)acres of natural wetlands within the Ludlow Creek Watershed, including riparian areas associated with Beaver Creek and an unnamed tributary of Beaver Creek, both of which flow into Ludlow Creek,which is identified by the Washington State Department of Wildlife Streamnet database(March 1999)as having a salmonid presence. 19.) Any activity or use of the Protected Area inconsistent with the purpose of this easement is prohibited.The following activities are prohibited within the Protected Area: [1]The placement or construction of any buildings, structures, or other improvements of any kind, including without limitation, pipelines, septic systems, drain fields, roads, parking lots, signs, sattelite dishes or antennae, yard lights, and kennels and other boarding facilities for animals; [2] Residential, agricultural, comercial, or industrial development or uses; [3] Any further subdivision pursuant to Chapter 58.17 RCW, as amended (or any successor provision(s)when applicable; [4] Grazing of livestock; [5] Damming, diking, dredging, filling, and alteration or malipulation of watercourses,wetlands, or ponds, except as deemed necessary by the Grantee to preserve, protect or enhance the conservation values of the Protected Area; [6] Mining of extraction of mineral resources, loil, sod, peat, rock, sand or gravel; [7]Any filling, cutting, dredging, drilling, excavation or grading of any kind in any amount; [8]Any activity or use which causes or is likely to cause any significant pollution of any surface or subsurface waters; [9]Any cutting of trees; [10]The dumping or storage of ashes, trash, garbage, sawdust, lawn clippings and wastes of any kind and in any amount; [11] The dumping or storage of materials including, but not necessarily limited to, tires, bricks, rocks, metal,wire, machinery, or building materials; [12]The storage of motor vehicles or trailers; [13] Use by domesticated animals; [14]The use of pesticides or herbicides; [15]The introduction of nonnative species of plants, including any use of the area for lawns or gardens; [16] Horseback riding; and [17] Operation of wheeled or motorized vehicles, except as demed necessary by Jefferson Land Trust to assist in implementing a Mangement Plan adopted pursuant to Section VII, Supparagraph A of the Conservation Easement, or to assist in a corrective action required under Section X of the Conservation Easement. 20.) An application for a road approach permit[RAP01-00052]was made for the property. The Road Approach was issued November 16, 2001 and finaled. 21.) An application for a sewage disposal permit[SEP01-00218]on the property was made on October 29, 2001 and issued November 11, 2001. The permit has yet to be finaled. • 22.) An application to subdivide 4�Tacres into 4 residential lots [SUB94-00035]was made on April 15, 1994 and issued November 13, 1995. The permit was finalized April 7, 2000 and filed under Auditor's File Nmber 432690. 23.) Prior to the commencement of any land disturbing activities and prior to issuance of building permit, a Storm Water Site Plan shall be developed to the standards of the Washington State Department of Ecology Storm Water Manual (current edition)and be submitted to the Department of Public Works for approval. Temporary erosion control methods for construction purposes (roads, facilities)shall be approved by the Department and employed during construction. 24.) There shall be no disturbance of soil or vegetation within the streams and wetlands including their associated buffers of any sort, including the prhobition of livestock grazing and vehicular access. The buffers are marked with fencing and signs. 25.) Construction of the access Driveway along the West boundary line of Lot 3 must be done in such a manner that disturbance of the forested wetland will be kept to a minimum. The lot owner shall incorporate design features into the Driveway design that will maintain any flow in the proposed Driveway area. 26.) Lot 3 and other lots within the Marsh and Meadows Short Plat are subject to the conditions, restrictions and protection of a Deed of Conservation Easement with the Jefferson Land Trust. The applicant shall be responsible to comply with the terms of the Coservation Easement, as filed under Auditor's File Number 432689 in the Jefferson County Auditor's Office. 27.) Certifacation that construction of the driveway was consistent with the Washington State Coastal Zone Management Program for federally licensed or permitted activities was excuted June 20, 2000. 28.) The site plan as submitted with the Building Permit application on April 14, 2003 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated April 14,2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 29.) Maximum Impervious Surface Area for lot 3 shall not exceed ten (10) percent. 30.) Minimum setbacks from the driveway access easement shall be 20 feet. Minimum side yard setback shall be at least 5-feet from the edge of the wetland buffer located east of the"Building Site". Minimum side yard setback from the west property line shall be 5-feet. Minimum rear yard setback shall be at least 5-feet from edge of the wetland buffer located south of the"Building Site". 31.) The building height shall not exceed 35 feet. 32.) The applicant is proposing to create or add 4,639 square feet of impervious surface and 13,500 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code and a Plat Condition requires that your proposal submit a Small Parcel Erosion and Sediment Control Plan.A SPESCP was submitted. 33.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 34.)
