SMP Response to Comments - Request for Additional Time

STATEMENT OF ISSUE:
The Shoreline Master Program (SMP) Comprehensive Update (MLA 08-475) is at the phase of state review where the
County must provide a Responsiveness Summary to Ecology. The deadline is July 30, 2010 and DCD staff needs
more time to review and respond to the public comment issues.
BACKGROUND:
The County has been working diligently on a state-required comprehensive update to the Shoreline Master Program
(JCC 18.25) for several years. The Board passed Resolution 09-77 last December directing DCD staff to submit the
Locally Approved SMP (LA-SMP) to the State for the final review and adoption process. The LA-SMP submittal
packet was sent to Ecology in March. The State held a public comment period and hearing in April/May this year
resulting in nearly 400 comment letters and verbal testimonies.
Per WAC 173-26-120, the County is required to provide WA Department of Ecology (Ecology) with a review of and
response to the issues raised by comments received during the state-wide public comment period. The WAC allows
local jurisdictions 45 days from the receipt of comments from Ecology to prepare this response. Ecology transmitted
the bulk of public comments to the County on May 28, making for a July 30 deadline. Ecology subsequently
transmitted additional related materials on four occasions (hearing transcript, lost comment letters, draft summary
table) to the County, last sent on July 19.
ANALYSIS/STRATEGIC GOALS/PROS and CONS:
County is required to complete SMP Update by December 2011; preparation of Responsiveness Summary is required
by WAC
FISCAL IMPACT/COST-BENEFIT ANALYSIS:
DCD staff time for SMP Update included in current budget
RECOMMENDATION:
Staff recommends the Board formally direct DCD to submit a 45-day timeline extension request to Ecology for
completion of the lA-SMP Responsiveness Summary. This would make the new deadline October 4,2010.
