The application was reviewed by the Jefferson County Department of Community Development staff on July 28, 2003 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Great blue heron colony and wetland areas. 2.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 3.) The Washington State Department of Fish and Wildlife reviewed potential impacts to Osprey and Great blue heron as part of the environmental &subdivision review process. WDFW in an email dated January 2002 indicated that their Priority Habitat Species Map indentifies a Great blue heron hookery and an Osprey nest within the Northeast corner of Section 21. The northeast corner of Section 21 is approximately 1/2 mile northeast of the plat of Timberton Village, Phase III. 4.) During the course of subdivision review for Timberton Village Phase III, wetland areas - were located, delineated and surveyed in the field. Under the Jefferson County Interim Critical Areas Ordinance, the wetland areas were protected as open space, each with vegetated protection buffers. One such wetland is located southwest of the lot 70. It is within an open space area and is protected with a 100-foot vegetated buffer, as noted on the final recorded plat. 5.) A permanent physical separation along the upland boundary of the wetland buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 6.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100)feet, whichever is less. Signs shall contain the following statement: "Wetland & Buffer- Do Not Remove or Alter Existing Vegetation." 7.) The applicant is proposing to create or add 3143 square feet of impervious surface and 2715 square feet of land disturbing activities. Conditions of final plat approval requires that your proposal submit a Small Parcel Erosion and Sedimentation Control Plan. The applicant submitted a small parcel erosion and sediment control plan. 8.) A Small Parcel Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 9.) The applicant and/or contractor shall be responsible to ensure that the submitted and approved (July 29, 2003) Small Parcel Erosion and Sediment Control Plan is implemented and that detention facilities are constructed in accordance with said plan and the Stormwater Management Manual for the Puget Sound Basin. 10.) The 19 residential lots within the Plat of Timberton Village Phase III were established through the long subdivision process. The final plat of Timberton Village Phase III was approved August 27, 2001 and recorded August 29, 2001 under Auditor's File Number 447260, in Volume 7, Pages 144-149 of plats. 11.) The parcel is a legal conforming lot that is designated as Single Family (MPR-SF) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 12.) This approval is for a Single Family Residence with attached garage only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. • • 13.) The site plan as submitted with the building permit application on July 21, 2003 has been reviewed for consistency under the MPRC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 21, 2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 14.) A Geotechnical Report was prepared and submitted to the County for development of the Timberton Village Phase Ill subdivision plat. The geotechnical report contained recommendations pertaining to earthwork activities that were both project and lot specific. By letter dated April 25, 2001, GeoResorces provided written documentation that the recommendations within the geotechnical report have been met. 15.) Maximum impervious surface area for lot 70 shall not exceed 45 percent. 16.) Minimum setback from Timber Heights Drive right of way line shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. 17.) The building height, including enlargements or sturctural modifications, shall not exceed 35 feet. 18.) Based on Section 3.107 of the Port Ludlow Master Planned Resort Code, Accessory Dwelling Units are prohibited within the MPR-SF zone. 19.) Outdoor residential storage shall be maintained in an orderly manner and shall create no - fire, safety, health or sanitary hazard.
