Sorry for so many emails, but below is a bit more that's come out since I sent this note on Friday, including a map and other analysis of the public lands sell-off language in the senate
budget reconciliation bill.
This budget bill could be voted on by the full Senate between now and July 4th. If it passes, it will mandate the sale of millions of acres within just FIVE YEARS, with the Secretaries
of Agriculture and Interior soliciting nominations for lands to be sold within 30 days. This isn't just about losing land. It's about a dangerous precedent that could result in future
sell-offs and the erosion of our public lands heritage and values.
We'd love more pro-public lands resolutions, letters, quotes, op-eds, social posts (videos!) and calls into congressional offices (please let me know if you call) showing outrage. We

The Senate Energy & Natural Resources Committee budget reconciliation bill text released June 11, and updated June 14 <https://www.wilderness.org/media/3852> , includes a range of extraordinary
giveaways aimed at privatizing public lands and advancing energy dominance at the expense of public lands and resources.
Key takeaways on the public lands sell-off title:
* The bill forces the arbitrary sale of at least 2 million acres of Forest Service and Bureau of Land Management lands in 11 Western states over the next five years, and it gives the
secretaries of the interior and agriculture broad discretion to choose which places should be sold off.
* Over 250 million acres of public lands are eligible for sale in the bill, including local recreation areas, wilderness study areas and inventoried roadless areas
* Public lands eligible for sale in the bill encompass over 250 million acres, including local recreation areas, wilderness study areas, inventoried roadless areas, critical wildlife
habitat and big game migration corridors.
* The bill directs what is likely the largest single sale of national public lands in modern history to help cut taxes for the richest people in the country. It trades ordinary Americans’
access to outdoor recreation for a short-term payoff that disproportionately benefits the privileged and well-connected.
* The June 14 updated version of the bill makes land with grazing permits eligible for sale. Although lands with undefined “valid existing rights” are still excluded, that term is now
best understood to encompass property interests like oil and gas leases, rights-of-way or perfected mining claims.
* The bill’s process for selling off lands runs at breakneck speed, demanding the nomination of tracts within 30 days, then every 60 days until the arbitrary multi-million-acre goal
is met, all without hearings, debate or public input.
* The bill sets up relatively under-resourced state and local governments to lose open bidding wars to well-heeled commercial interests. It also fails to give sovereign Tribal Nations
the right of first refusal to bid on lands, even for areas that are a part of their traditional homelands or contain sacred sites.
* National monument lands may also be at risk from this proposal. In a Department of Justice opinion released last week, the Trump Administration dubiously claimed the unprecedented
legal authority to revoke national monument protections. If they were to attempt to follow through on this, another 13.5 million acres of our most cherished public lands could be threatened
with sell-off.
* The public lands sell-off provision masquerades as a way to provide more housing, but it lacks safeguards to ensure land is used for that purpose, and it sets up a system where lands
could be sold or resold for non-housing uses after just 10 years. Research suggests that very little of the land managed by the BLM and USFS is actually suitable for housing.
* Land agencies already have ways to identify public lands for uses like housing if it serves community needs. Jury-rigging a new way to force such “disposal” as part of the budget reconciliation
process sets up a precedent to quickly liquidate huge chunks of America’s treasured lands in the future whenever politicians have a pet project to pay for.

1. Public Lands Sell-off in Budget Reconciliation - The "One Big Beautiful Bill Act," which is currently before the Senate, includes a provision to sell off up to 3 million acres of
national public lands in states across the West. Senate Energy and Natural Resources Chair U.S. Senator Mike Lee (R-Utah) inserted the provision <https://www.energy.senate.gov/services/files/B836D36
C-20F1-48C6-9903-B1DABD5A6EBE> into the budget reconciliation bill <https://www.energy.senate.gov/services/files/DF7B7FBE-9866-4B69-8ACA-C661A4F18096> on Wednesday night. Chairman
Lee wants to mandate the sell-off of between 2 million and 3 million acres of public lands across 11 western states (UT, AK, AZ, CA, CO, ID, NV, NM, OR, WA, WY). His legislative text
would target both Bureau of Land Management (BLM) and U.S. Forest Service land.
There is no requirement that any housing built in response to this bill be affordable or meet any affordable housing requirements. There is no provision to prevent lands sold under
Lee’s bill from being developed into high-end vacation homes, Airbnbs, or luxury housing projects. After 10 years, privatized lands would face no building or use restrictions whatsoever,
allowing them to be repurposed for uses other than housing, such as golf courses, resorts or industrial development.
The House stripped a proposed sale of public lands from their version of the bill, which was inserted as an amendment from Reps. Mark Amodei (R-Nev.) and Celeste Maloy (R-Utah) and
would have sold off roughly 500,000 acres in Nevada and Utah — a fraction of Lee’s proposed sales.
2. National Monuments - On May 27, 2025, the Department of Justice quietly issued an opinion <https://www.justice.gov/olc/media/1403101/dl> through its Office of Legal Counsel titled
“Revocation of Prior Monument Designations” that claims Presidents have the ability to eliminate millions of acres of national monuments. The opinion was posted on DOJ’s website on
Tuesday, June 10.
The Washington Post <https://www.washingtonpost.com/climate-environment/2025/04/24/trump-national-monument-reductions-mining-oil/> reported that the Trump administration has a short
list of six national monuments they’re considering slashing: Baaj Nwaavjo I’tah Kukveni-Ancestral Footprints of the Grand Canyon (AZ), Ironwood Forest (AZ), Chuckwalla (CA), Organ Mountains-Desert
Peaks (NM), Bears Ears (UT) and Grand Staircase-Escalante (UT).
In February, on his first day in office, Interior Secretary Doug Burgum announced a plan to review and remove public land protections, threatening more than 13.5 million acres of monuments

signed a proclamation attempting to strip away protections for the Pacific Islands Heritage National Monument to commercial fishing. And in late May, Interior Secretary Doug Burgum

and histories many monuments were designated to tell.
3. Land and Water Conservation Fund and Great American Outdoors Act - FY26 President’s Budget has egregious attacks on LWCF <https://static1.squarespace.com/static/58a60299ff7c508c3c05f2e1/t/683a3cc
713c73e4fde61c47a/1748647111971/LWCF+Coalition+press+release_FY26+budget+attack.pdf> -it proposes to divert a huge amount of LWCF federal land acquisition project funding to deferred
maintenance, gutting the program and dismantling the Great American Outdoors Act. Additionally, the budget would also massively cut the NPS State and Local Assistance (stateside) and
ORLP. Other grant programs appear to be funded.
The proposal would cut all annual priority projects at our National Parks, National Wildlife Refuges, National Forests and other public lands that protect our nation’s treasures, ensure
access for sportsmen and recreationists of all kinds, conserve wildlife habitat and clean water, and provide an economic lifeline to rural and gateway communities.
This proposal would cut the heart out of the Great American Outdoors Act by breaking the deal struck in that legislation to invest in BOTH critical conservation AND maintenance needs
on our national public lands, WITHOUT creating a false choice between the two.
