O'Meara with all <br />members present. <br /> <br />Planning Director David Goldsmith, Prosecuting Attorney Bill <br />Howard, Sanitarian Randy Durant, and!Building Inspector Jack Padia reported <br />to the Board that a building permit ~pplication has been received for <br />Killapie Beach Plat. According to R$solution 36-77, a soils engineer's <br />and/or geologist's report,specifyingiany requirements to provide assurance <br />of soil stability for the proposed ptoject,shall be provided to the County <br />at the time of any building permit application. The report received <br />states that the soil is unstable. Tl1te Board advised that the report should <br />be given to the Building Department ~or determination on whether a building <br />permit should or should not be issued. <br /> <br />Hearing. Petition for vacation of portions of Myrtle Street, <br />White Street, and Magnolia Avenue iniKuhnsville and Bayview Additions; <br />Benmoor Enterprises, petitioners. (cqntinued from February 11, 1980) <br />William Stanley appeared and advised ,the Board on the intentions of the <br />petitioner, which is to utilize the vacated street for drainfield area. <br />Mr. Stanley expressed concern about the drainfield runoff contaminating <br />his property. Mr. Stanley told the toard there were to be more property <br />owners protesting the vacation but tl~y thought the hearing was continued <br />on the 11th of March. The Planning qommission & Public Works Department <br />recommend the Board deny the vacatio~ of portions of White and Myrtle Street <br />until such time the Public Works Dep4rtment adopts a comprehensive study <br />of the traffic patterns in the area, iand allow the vacation of portion of <br />the intersection of Magnolia Avenue ~nd Myrtle Street lying south of the <br />Old County Road in exchange for a tr~angidar. portion of property lying <br />west of White Street to the intersection of the Old & New County Roads. <br />Commissioner Brown moved to approve the vacation as recommended by the <br />Planning Commission and Public Works!Department. Commissioner Mercer <br />seconded the mo~ion. Unanimous. <br /> <br />Paul Murphy, Board Membe~ of the Gardiner Community Center, <br />talked with the Board about the progress of the work they're doing on the <br />Community Center. He requests permi$sion to insulate under the old porch <br />at an approxamte cost of $7-7.00. ThE$ Board approved this request. They <br />discussed the parking area and landsqaping along with shades for the win- <br />dows and table and chairs for the doWnstairs hall. The Board will call <br />for proposals on the window shades. ' <br /> <br />Mr. & Mrs. Carl Wilson b~ought in letters requesting the re- <br />opening of County Road No. 88-A. Chairman O'I1eara read the letters along <br />with a letter received from Duckabus~ Community, Inc. opposing the road <br />opening. The Board will speak with ~ngineer about this request. <br /> <br />Hearing. Petition for vacation of Tract B, Oak Bay Waterfront <br />Tracts; Thomas H. Peters, petitioneri Mr. Peters requests the vacation of <br />Oak Bay Waterfront Tract B (Less N30Q' S. of W. extension of beach road) <br />section 29, T 29 N RIE, W.M. Parcel ~o. 976800067, so the property can be <br />used for timber purposes. One perso~ appeared. The Public Works Depart- <br />ment recommends that before approval !the property owners grant to the <br />County, by instrument, the right to!make necessary slopes for cuts and <br />fills, etc. for future use on the right-of-way, Commissioner Brown moved <br />to allow the vacation of Tract B outiof the Oak Bay Waterfront plat with <br />the stipulation that they grant any ~asement in the future that might be <br />needed for cuts or fills when the ro4d is developed along next to the <br />property.
